2037o u RESOLUTION NO.2037 A RESOLUTION ACCEPTING AN EASEMENT TO THE CITY OF MOSES LAKE FROM HANSON PROCESSING,L.L.C. Recitals; 1.Resolution No. 238 provides that all grants of real estate, or any interest therein, to the City of Moses Lake, shallnotbe accepted until a resolution hasbeenduly passed by the City Council. 2.Hanson Processing has presented an easement to the City of Moses Lake. Resolved: 1.An easement for utility and construction purposes for the following described property is hereby accepted by the City of Moses Lake: PNSC/HANSON WATER LINE EXTENSION a utility easement for municipal purposes,to the City of Moses Lake,a municipal corporation,across the following described property (Assessor's property tax parcel #18-0210-004)to wit: That portion of the East half of Section 20,Township 19 North,Range 29 East,W,M.,Grant County,Washington,lying East of the following described line: Beginning at a point on the North line of said Section 20 that is NS^S'SO'W,1353.15 feet from the Northeast corner of said Section; thence S00*24'11"W,parallel with and 10 feet distant East at right angles to the center line of the existing railroad main line that runs North-South through said Section,5360.90 feet to the point of terminus of said line,said terminus point being on the South line of said Section 20,N89*16'05"W,1351.84 feet from the Southeast corner of said Section 20, The City of Moses Lake shall have the right of ingress to and egress from the easement area across adjacent lands of the grantor/s at all times for the purposes of exercising any of its rights.Said utility easement for municipal purposes being: A utility easement across the Southeast quarter of the Northeast quarter and a portion of the Southwest quarter of the Northeast quarter of Section 20,Township 19 North,Range 29 East,W.M.,Grant County, Washington,said easement being 30 feet wide,15 feet each side of the following described center line: Commencing at the East 1/4 corner of said Section 20;thence along the said East line of said southeast quarter of the Northeast quarter of said Section,NQ0°24'57BE,389.89 feet to the TRUE POINT OF BEGINNING of the center line being described;thence at right angles to the said East line of the Southeast quarter of the Northeast quarter of said Section N89°35'Q3"W,1352.63 feet to the point of terminus of said center line being described,a point on the East line of that portion of the said Northeast quarter of said Section 20,deeded to the Pacific.Northwest Sugar Company in that certain Statutory Warranty Oeed filed April 23, 1996,on Reel 077,page 0008 of Deeds,under Auditor's File Number 960424003, Records of Grant County.Washinaton. Grantor shall have the right to use the easement area for purposes not inconsistent with the City of Moses Lake's full enjoyment of the authority and rights hereby granted.Such determination shall be made solely by the City of Moses Lake. The Grantor's,for themselves and their successors,assigns,lessees and licensees,hereby covenant and agree that they shall not place^construct or maintain any buildings,structures or other improvements within the easement area. \^J Grantor's covenants shall run with above described lands and be binding upon the Grantor's successors and assigns.All of the authority and rights of the City of Moses Lake as herein provided shall inure to the benefit of the City of Moses Lake's successors and assigns.
