RESOLUTION NO.2038
A RESOLUTION INITIATING THE PROCEDURE FORVACATING RIGHT-OF-WAY
DEDICATED FOR THE DEVELOPMENTOF FERN DRIVEAND CROUSE STREET
RECITALS:
1. There exists right-of-way dedicated for the development of Fern Drive andCrouse Street whichis not
necessary forthe city's right-of-way requirements.
2. RCW 35.79 providesthat a public street may be vacated upon resolution initiated and passed by the
legislative authority of the jurisdiction where the street is situatedand that such resolution shall fix a
time when the petition will be heard and determined and which shall not be more than sixty days nor
less than twenty days after the passage of such resolution.
RESOLVED:
1.The petition forthe vacation of the following described public right-of-way shall be accepted:
A portionof Fern Drive and Crouse Street described as follows:
A parcel of land in the Northeast 1/4, Section 28, Township 19 North,Range 28 East W.M.;Grant
County,Washington,described as follows:
Commencing at the monument at the intersection of Fern Drive and Crouse Street as shown on the
Bennett Addition Plat per records of Grant County,Volume 7, Page 16 of Plats;thence North
00°11'50"East,40.00 feet;thence South 89°48'10"East,30.00 feet to the east right-of-way line of
Fern Drive and the point of beginning;thence South 00°11'50"West,70.00 feet;thence North
89°48'10"West,70.00 feet;thence on a non-tangent 70.00 foot radius curve concave to the northwest,
an arc of 109.96 feet, the chord being North 45°11'50" East, 98.99 feet to the point of beginning;
containing 1052 square feet more or less.
2. A public hearing before the Planning Commission shall be set for June 12, 1997; the first reading of
a vacation ordinance shall be set for July 8,1997;and a second reading of a vacation ordinance shall
be set for July 22,1997.
