2064RESOLUTION NO.2064 A RESOLUTION INITIATING THE PROCEDURE FOR VACATING RIGHT-OF-WAY DEDICATED FOR THE DEVELOPMENT OF A PORTION OF KITTLESON ROAD RECITALS: 1. There exists right-of-way dedicated for the development of Kittleson Roadwhichis not needed bythe City of Moses Lake. i j 2.RCW 35.79 provides that a public street may be vacated upon resolution initiated and passed by the ^-^legislative authority of the jurisdiction where the street is situated and that such resolution shall fix a timewhen the petition will be heardand determined and which shall notbe morethan sixtydays nor less than twenty days after the passage of such resolution. RESOLVED: 1. The vacation of the following described public right-of-way shall be initiated: Parcel 1:A portion of Kittleson Road located inthe NW%of Section 36 and the SWA of Section 25, Township 19 North,Range 28 East,W.M.which is located 30'each side of the following described centeriine: Beginning at the centeriine of the westerly terminus of Kittleson Road as shown on the Moses Lake Travel Plaza Second Short Plat filed in Book 5, Page 59 at the GrantCountyAuditor'sOffice;thence North 89°18'09"West,2,115.19 feettothe southwest corner of Section 25,Township 19 North,Range 28 East,W.M.,and to the terminus of said centeriine. and Parcel 2:A portion of Kittleson Road located in the NE%of Section 35,Township 19 North,Range 28 East.W.M.,described as follows: All that portio of the 30 foot road right-of-way dedicated on the Maiers Short Plat filed at the Grant County Auditor's Office inVolume 1 of plats on page 67. Subject to a municipal easement for city utilities over the southerly 40 feet of the above described Parcel 1 and the easterly 30 feet of the above described Parcel 2. 2.A public hearing and the first reading ofa vacation ordinance shall be set for October 28,1997;and a second reading of a vacation ordinance shall be set for nov .11 1997.
