2068w u u RESOLUTION NO.2068 A RESOLUTION DECLARING THE EXISTENCE OF AN EMERGENCY AND DISPENSING WITH THE STATUTORY COMPETITIVE BIDDING REQUIREMENTS Recitals: 1.The City of Moses Lake is a code city operating under the authority of RCW 35A. 2.The city,under RCW 35A.11.020 has: ". . . any authority ever given to any class of municipality or to all mu nicipalities of this state . . ." 3.The city has the authority to commence a public work without complying with the statutory bid requirements in an emergency situation under the authority given by case law and by statute, RCW 35.22.620(6). 4. The Peninsula Wastewater Force Main in the past two weeks has evidenced significant failure. The coupling bands joining two sections of pipe has given way in one instance. In another instance a leak was discovered which was due to the pipe rusting out. With these recent failures the force main should be replaced as soon as possible so that there are no further failures of the main and the potential leakage of wastewater. Inthe two recent major failures, the wastewater was reasonably contained and there was limited adjacent property damage or environmental damage.The delay in the replacement of the force main by complying with the statutory bid requirements could put off the replacement until the spring of 1998 because of construction restrictions due to weather conditions. 5. There are sufficient unexpended monies budgeted and available for sewer main replacement. Resolved: 1.An emergency exists since there is the potential for additional failures of the Peninsula Wastewater Force Main potentially causing damage to adjacent property owners and environmental damage if the main is not replaced as soon as possible. 2.Because an emergency exists, underthe laws of the State of Washington, the statutory bid requirements are waived. 3. Quote packages shall be sent to contractors in the area that are capable and qualified to perform this public work.Contractors shall have a limited time to respond.The City Manager is authorized to approvethe contractimmediately afterthe quote opening and inform the City Council of the execution of the contract.
