2140u u LJ RESOLUTION NO.2140 A RESOLUTION INITIATING THE PROCEDURE FOR VACATING RIGHT-OF-WAY DEDICATED FOR THE DEVELOPMENT OF WHITE DRIVE,DALE ROAD,AND EARL ROAD RECITALS: 1.There exists right-of-way dedicated for the developmentofWhite Drive,DaleRoad, and Earl Roadwhich is not needed by the City of Moses Lake. 2. RCW 35.79 providesthat a public street may be vacated upon resolution initiated and passed by the legislative authority ofthe jurisdiction where the street issituatedandthatsuch resolution shall fix atime when the petition will be heardand determined and which shallnot be more than sixty days norless than twenty days after the passage of such resolution. RESOLVED: 1.The vacation of the following described public right-of-way shall be initiated: All ofWhite Driveand Dale Road and that portion of Earl Road lying southwesterly of the northeasterly line of Lot1extended tothe northwesterly line of Lot2,ofthe plat of Knolls Vista 18th Addition,recorded in Volume 9 of Plats,page 7,records of Grant County,Washington, exceptthatan easement formunicipalpurposes shallbe retainedforallofthat portion of Earl Street being vacated and for the northeast half of the north 155'of that portion ofWhite Drive being vacated. 2. A publichearing before the Planning Commission shall be set for November 12,1998;the first reading of a vacation ordinance shall be set for December8,1998;and a second reading ofa vacation ordinance shall be set for January 12,1999.
