2165u U RESOLUTION NO.2165 A RESOLUTION ALLOWING THE SKYLINE WATER SYSTEM TO CONNECT TO THE CITY OF MOSES LAKE'S WATER SYSTEM RECITALS: 1.The city has an annexation policy set forth in Resolution No.1307 requiring annexation ofthe involved property or the execution of an annexation agreement by the involved property owners priorto the extension of city utilities outside the city limits. By this reference Resolution No.1307 is incorporated in this resolution. 2.Skyline Water System,an independent privately owned water system serving approximately 99 residential housing units located beyond the city's corporate limits is tainted with trichloroethylene (TCE). 3.The United States Environmental Protection Agency has been searching fora source of untainted, potable water forthe area served by the Skyline Water System. 4. The City of Moses Lake has offered to provide water to the Skyline Water System under certain conditions. Bythis reference a letterwrittento Mr.Harold Moberg dated January 20,1995 with regard to the Skyline Water System setting forth the conditionswhich must be met before the city wouldallowa connection by the SkylineWater System to the city'swater system is incorporated within this resolution. 5. The United States Environmental Protection Agency has requested the city providepotablewater to the Skyline Water System under certain conditions. By this reference a letter fromthe USEPA dated February 17,1999 setting forth those conditionsby this reference is incorporated within this resolution. RESOLVED: 1.The cityagrees to provide potable water from the city's utility system to the SkylineWater System under the following conditions: A. The city will bulk sale the water to the Skyline Water System at commercial rates as ifthe li Skyline Water System was a commercial user.The rates will be identical to those rates for ^"^any commercial user as set forth by ordinance.In addition,an 8%surcharge is added to the commercial rate pursuant to ordinance. B. Allcosts of connecting to the city system will be borne by Skyline Water System.A master meter and proper backflow prevention device must be installed.The connection cannot occur without city approval of connection design. C. The city will providesufficientwater fora maximum of 99 residentialliving units inthe area served by the Skyline Water System. 2.The city will not requirean ExtraTerritorial Utility Agreementto be executed by the representa tives of the Skyline Water System or those residential living units served by the Skyline Water System.This is not considered a deviation or exception to the city's policyinas much as the service is not provideddirectlyto the residential living units but to the Skyline Water System and the Skyline Water System owns no appreciable real propertywhich would be subject to any annexation or Extra Territorial Utility Agreement. 3.The city agrees to sell water from its utility system to the Skyline Water System so long as the city has received new water rights inan amount sufficient to cover the amount of water that is being sold to the Skyline Water System.These water rights should be those that are received and would be available ifthe Cityof Moses Lake allowed a connection of its city water to the Skyline Water System. 4.The water service to the Skyline Water System will be interruptible with appropriate six-month notice unless the additionalwater supply as previously mentioned is provided to the City of Moses Lake.
