A RESOLUTION INITIATING THE PROCEDURE FORVACATING RIGHT-OF-WAY
DEDICATED FOR THE DEVELOPMENT OF THIRD AVENUE AND ADJOINING
ALLEYS
RECITALS:
1.There exists right-of-way dedicated for the development ofThird Avenue and adjoining alleyswhichisnot
needed by the City of Moses Lake.
2. RCW 35.79 providesthat a public street may be vacated upon resolution initiated and passed by the
legislative authority ofthejurisdictionwhere the street is situated and that such resolution shall fixa time
when the petition will be heardand determined andwhich shallnot be more than sixty days norless than
twenty days after the passage of such resolution.
RESOLVED:
1.The vacation of the following described publicright-of-wayshall be initiated:
The 30'section of Third Avenue adjacentto Lots 9-12,Lewis Elliott Addition No.2,the 10'parcel of
property adjacenttothe southwestsideofLot9, LewisElliott Addition,andthe 20'parcel of property lying
between Lots 5-12,Lewis Elliott Addition
2. A public hearing beforethe Planning Commission shall be set for May 27,1999;the first reading of a
vacationordinanceshallbe setfor June 22,1999;anda second reading ofavacationordinanceshallbe
set for July 13,1999.
