2210RESOLUTION NO.2210 A RESOLUTION OF SUPPORT OF THE ACCEPTANCE BY THE CITY OF MOSES LAKE OF THE MOSES LAKE STATE PARK AND ADJOINING PROP ERTY RECITALS: 1.Pursuant to action by the Washington State Legislature, codified in Chapter 161 of the Laws of 1999,the Moses LakeState Parkand adjoining park property isto be transferred to the Cityof ^)Moses Lake tobeusedas a city park. 2. House Bill 1718 transferring the Moses Lake State Parkand adjoining propertyto the Cityof Moses Lake has been signed by the Governor of the State of Washington. 3.The conveyance is to be made upon the Washington State Parks and Recreation Commission obtaining necessary waivers or other adequate legal assurance with respect to the removal or modificationof any applicable deed restrictionsor reversionary clauses. 4. Ownershipofthe Moses LakeState Parkand adjoining property shallrevertto the Washington State Parks and Recreation Commission should the Cityof Moses Lake breach any covenants of the transfer. 5. The act mandates that the Cityof Moses Lake shalltake allmeasures necessary to accept the Moses Lake State Parkand adjoining property. 6. The Washington State Parks and Recreation Commission has approved the transfer of the Moses Lake State Park and adjoining property to the City of Moses Lake. RESOLVED: 1.The City Council ofthe City of Moses Lake agrees to accept the Moses Lake State Park and adjoining property with all encumbrances ofrecord or otherwise. 2.The City of Moses Lake will accept full responsibility under IAC project agreements 67-554A,86- 504D,and 88-503D. 3.The Moses Lake State Park and adjoining property shall revert to the Washington State Parks and Recreation Commission in the event the property ceases to be used as a park. 4. A resolution of acceptance ofthe Moses Lake State Park and adjoining property shall be adopted by the City of Moses Lake. 5.The City of Moses Lake shall take all measures necessary to accept the Moses Lake State Park and adjoining property.
