2240u U RESOLUTION NO.2240 A RESOLUTION INITIATING THE PROCEDURE FOR VACATING RIGHT-OF-WAY DEDICATED FOR THE DEVELOPMENT OF PORTIONS OF PAXSON DRIVE AND BLANCHET AVENUE RECITALS: 1.Thereexists right-of-way dedicatedforthedevelopmentof portions ofPaxson Drive andBlanchetAvenue whichare not needed by the Cityof Moses Lake. The portionsofthe right-of-way inquestion are shown on the attached map which is incorporated withinthis resolution by reference. 2. RCW 35.79 providesthat a public street may be vacated upon resolution initiated and passed by the legislative authority ofthe jurisdiction wherethestreetissituated andthatsuch resolution shall fix atime when the petition will be heardand determined andwhichshallnotbe morethan sixtydays norless than twenty days after the passage of such resolution. 3. Most propertyowners adjacent tothe portionsof Paxson Drive and BlanchetAvenueto be vacated have either petitioned the Cityof Moses Lakeorassented to avacationofthe right-of-way inquestion. Acopy of the relevant petitionand letter stating the assent are incorporated withinthis resolution by reference. RESOLVED: 1.The vacation of the following described public right-of-way shall be initiated: A portionof Paxson Drivelegally described as: Allthat portion of Paxson Drivededicated on the KnollsVista 18th Addition Plat, per Grant County Auditor platrecords Volume 9, Page 7, located inthe SW1/4,SW1/4,Section 15,Township 19 North, Range 28 East W.M.. And That portion of KieferAvenue,presently named Paxson Drive,dedicated on the Platof ParkOrchards Tracts Plat,per Grant County Acreage records page 36,located in the SW1/4,SW 1/4,Section 15, \^J Township 19 North,Range 28 East,WM.described as follows: East of a line that is paralleland 30.00 feet east of the west boundary line ofsaid SW 1/4. and A portion of Blanchet Avenue dedicated on the ParkOrchardTracts legally described as: Thatportion ofSixthAvenue, presentlynamed BlanchetAvenue, dedicatedonthe PlatofParkOrchards Tracts, per Grant County Acreage records Page 36, located in the SW 1/4,SW 1/4, Section 15, Township 19 North,Range 28 East, W.M.,described as follows: Beginning at the southwesterly right-of-way lineof White Drive and extending southwesterly to the northeasterlyright-of-way lineof Paxson Drive.Containing 1.03acres, more or less. Subject to a municipal easement for city utilities described as follows: Beginning atthe most easterly cornerof lot1,H.L.H.Plat,perGrantCountyAuditorrecordsvolume 11, pages 56&57;thence South 62°12'45"West,185.00 feet along the southeast boundary ofsaidlot1; thence at right anglestosaidboundarySouth 27°47'15"East,60.00 feet;thence North 62°12'45"East, 30.00 feet;thence North 27°47,15"West,30.00 feet;thence North 62°12'45"East, 154.98 feet to the southwesterly right of way lineWhite Drive;thence North 27°44'37"West, 30.00 feet to the point of beginning. Also,subjectto a 30 foot wide public utility easement located along the southeasterlyone halfof that partof Blanchet Avenue being vacated. 2. A public hearing andthe first reading ofavacation ordinance shall be set for May 9,2000 andasecond reading of a vacationordinanceshallbe set forMay23,2000.
