ARESOLUTION REGARDINGTHE MOSES LAKESPRING FESTIVALTO BE HELDMAY25,26,and 27,2001
RECITALS:
1.The Moses Lake Spring Festival Committee has organizeda Spring Festival forthe Cityof Moses Lake
to occur on May 25,26,and 27,2001.
2.The City of Moses Lake endorses theMoses Lake Spring Festival concept.
RESOLVED:
1.The Moses Lake Spring Festival shall be allowedtouse cityproperty and streets for its Festival related
activities;i.e.a carnival so long as itdoes notobstructany right-of-way,food fair,craft show,and relatedactivitiesatMcCoshPark,a 10K -5K run,a canoe race thatwould cross over Cascade Valley Park,
Peninsula Park,Montlake Park,and McCosh Park,a triathlonwhich would begin at Montlake Park andutilizecitystreets,the use ofthearnphitheaterduring the festival,parades thatwouldutilize citystreets,
a car show at the Civic CenterPark,a pickle ball contest and competition on Third Avenue,and a 3 on3basketballtournarnentutilizingaparkinglotatMcCoshPark.
2.The City Council of the Cityof Moses Lake approves of street barricading for the parade and otherFestivalrelatedactivitiesasisrequiredbytheMosesLakeSpringFestival,including a sidewalk salesponsoredbytheMosesLakeBusinessAssociationheldinconjunctionwiththeMosesLakeSpring
Festival,to be set forth in a letter to the City Manager.Discussions with regard to street barricadingshouldbeheldwiththeMosesLakePoliceChieforhisdesigneesothatitisunderstoodwhenandwherebarricadingistotakeplace.Responsibility for obtaining and setting barricades shall remain with theMosesLakeSpringFestivalorMosesLakeBusinessAssociationunlessotherwiseagreeduponwiththeMosesLakePoliceChieforhisdesignee.
3.The city shall absorb the in-kind financial expenses for police and securityservices,street sweeping,
garbage pick-upand solid waste dumping fees.The garbage pick-up,solidwaste dumping fees and theexpenseforstreetsweepingandpoliceandsecurityservicesabsorbedbythecityisconsideredanadditionalexpenseofprovidingcityservicesduringtheperiodtheFestivaltakesplace.
4.Ifthere are any special requests to supply water,itwillbe the decision ofthe Municipal Services Director
as tothe charges to be assessed.
5.Parking shallbe prohibitedalongparts ofthe parade route,such parade totakeplaceon May 26,2001foraperiodoftimedeterminednecessarybytheMosesLakePoliceChieforhisdesigneeandtheMoses
Lake Spring Festival Committee.The parking prohibitionis authorized by Moses Lake Municipal Code10.12.020 and the prohibition notificationshallconformtosaid Municipal Code provision.
6.The Moses Lake Spring Festival shall provide liabilityinsurance inamountsand withthetypeof coveragerequestedbytheCityManagerwiththeCityofMosesLakebeingnamedasanadditionalnamedinsured.
7.The Moses Lake Spring Festivalshallexecute anindemnity/hold harmless agreement whereby theMosesLakeSpringFestivalshallholdtheCityofMosesLakeharmlessfromanyclaimsfordamageandindemnifytheCityofMosesLakefromanyliabilitywhichmayariseasaresultoftheMosesLakeSpringFestivalusinganycityproperty,publicstreets,or public sidewalksfor any Festival related activity,
