ARESOLUTION REGARDINGTHE MOSES LAKESPRING FESTIVALTOBE HELDMAY23,24,25,26,and 27,2002
RECITALS:
1.The Moses Lake Spring Festival Committeehas organized a Spring Festival for the Cityof Moses LaketooccuronMay23,24,25,26,and 27,2002,
2.The Cityof Moses Lake endorses the Moses Lake SpringFestival concept
RESOLVED:
1.The Moses Lake Spring Festival shallbe allowed touse city propertyand streets for its Festival relatedactivities;i.e.a carnival so long as itdoes not obstruct any right-of-way,food fair,craft show,and relatedactivitiesatMcCoshPark,a 10K -5K run,a canoe race thatwouldcross over Cascade Valley Park,Peninsula Park,Montlake Park,and McCosh Park,the use of the amphitheater during the festival,parades that wouldutilize citystreets,a car show at the CivicCenter Park,a pickle ball contest andcompetitiononThirdAvenue,and a 3 on 3 basketball tournamentutilizinga parking lot at McCoshPark.
2.The City Councilof the City of Moses Lake approves of street barricading for theparade and otherFestivalrelatedactivitiesasisrequiredbytheMosesLakeSpringFestival,including a sidewalksalesponsoredbytheMosesLakeBusinessAssociationheldinconjunctionwiththeMosesLakeSpringFestival,to be set forth in a letter to the City Manager.Discussions with regard tostreet barricadingshouldbeheldwiththeMosesLakePoliceChieforhisdesigneesothatitisunderstoodwhenandwherebarricadingistotakeplace.Responsibility for obtainingand setting barricades shall remain with theMosesLakeSpringFestivalorMosesLakeBusinessAssociationunlessotherwiseagreeduponwiththeMosesLakePoliceChieforhisdesignee.
3.The city shall absorb the in-kind financialexpenses for police and securityservices,street sweeping,garbage pick-up and solid waste dumping fees.The garbage pick-up,solidwaste dumping fees and theexpenseforstreetsweepingandpoliceandsecurityservicesabsorbedbythecityisconsideredanadditionalexpenseofprovidingcityservicesduringtheperiodtheFestivaltakesplace.
4.Ifthere are any special requests tosupplywater,itwillbe the decision oftheMunicipal Services Director
as tothecharges tobe assessed.O 5.Parking shall be prohibited alongparts oftheparade route,such parade totakeplace on May 25,2002foraperiodoftimedeterminednecessarybytheMosesLakePoliceChieforhisdesigneeandtheMosesLakeSpringFestivalCommittee.The parkingprohibition is authorizedbyMoses Lake Municipal Code10.12.020 and theprohibitionnotification shall conform tosaid Municipal Code provision.
6.The Moses Lake Spring Festival shall provideliabilityinsurance inamountsand withthetypeof coveragerequestedbytheCityManagerwiththeCityofMosesLakebeingnamedasanadditionalnamedinsured.
7.The Moses Lake Spring Festival shall execute an indemnity/hold harmless agreement whereby theMosesLakeSpringFestivalshallholdtheCityofMosesLakeharmlessfromanyclaimsfordamageandindemnifytheCityofMosesLakefromanyliabilitywhichmayariseasaresultoftheMosesLakeSpringFestivalusinganycityproperty,publicstreets,or public sidewalks for any Festival related activity.
