A RESOLUTION ACCEPTINGANAMENDMENT TO CONTRACT ANDRELEASEOFCOVENANTANDAUTHORIZINGEXECUTIONOFTHEAMENDMENT
RECITALS:
1.The Cityof Moses Lake accepted aDedication Deed frorn theUnited States Department oftheinterior,Bureau ofReclamation,ColumbiaBasin Project dated September 14,1989 whichconveyed all oftheUnitedStates'right,title,and interest to several parcels ofland to the city.O 2.The CityofMoses Lake executed a Contract and Release of Covenant dated July 10,1998 where theUnitedStatesreleasedareversionaryprovisiononaportionofthelandinvolvedinthe1989dedicationdeedsothatthecitycouldexchangethepropertyforotherrealestatesreferredtoasParcelAinthe1998ContractandReleaseofCovenant.
3.The Cityof Moses Lake has requested anamendment to the covenant on Parcel A referredto inthe1998ContractandReleaseofCovenantsothatthecitycanuseitforanymunicipalandrelatedpurposetothebenefitofthegeneralpublicwhichwasthesamelanguageasreferencedintheoriginalcovenantinthe1989DedicationDeed.
4.The United States Department of the Interior,Bureau of Reclamation,Columbia Basin Project hasagreedtoamendthe1998ContractandReleaseofCovenantasrequestedbythecityandhasprovidedanamendmenttotheContractandReleaseofCovenant.
RESOLVED:
1.The Cityof Moses Lake accepts theAmendment to the Contract and Release ofCovenantwhich isattachedtothisresolutionandincorporatedbyreference.
2.TheCity Councilauthorizes theCity Managerto execute the Amendment totheContract and ReleaseofCovenantasprovidedbytheUnitedStatesDepartmentoftheInterior,Bureau of Reclamation,Columbia Basin Project.
