Covey, Ma RESOLUTION NO. 2995 A RESOLUTION DECLARING AN EMERGENCY AND WAIVING THE STATUTO- RY BIDDING REQUIREMENTS DUE TO THE EMERGENCY RECITALS: 1.The city owns and operates a municipal water system which serves an area in the city generally known as the Wheeler Road Industrial Area. 2.The Wheeler Road Industrial Area contains several businesses and industrial concerns which rely upon the city's water system for service. 3.On August 11, 2008 the variable frequency drive (vfd) which controls the speed and operation of the Well 17 pump, sparked and caused a fire in the Well 17 pumphouse. The fire destroyed the vfd and the main wiring and possibly damaged the pump motor, controller, air conditioner, and transformer. Well 17 cannot operate until these items are either replaced or repaired. 4.Well 17 is the main well in the Wheeler Road Industrial Area that supplies water to all the business and industries. The only other well serving the Wheeler Road Industrial Area is Well 18 which by itself barely pumps the quantity of water needed to serve the businesses and industries during normal operations. There would be catastrophic impacts on the businesses and industries in the Wheeler Road Industrial Area if Well 18 ceases operating for any reason. Well 17 provides redundancy in the Wheeler Road Industrial Area. 5.The use of Well 17 is necessary in order to meet industrial water needs in the Wheeler Road Industrial Area. It is necessary to get Well 17 back in operation as soon as possible so that there will be enough water available in the Wheeler Road Industrial Area to serve business and industry. 6.The cost to repair Well 17 to make it operable and have it produce sufficient water will cost approxi- mately $80,000. 8. RCW 39.04.280(1)(c) recognizes an exception to the bidding requirements for municipalities in the event of an emergency. RESOLVED: 1.An emergency exists in the Wheeler Road Industrial Area in as much as there may not be enough water to supply business and industries in the Wheeler Road Area if Well 17 is not repaired as soon as possible. The emergency exists for the reasons set forth in the recitals. 2.The statutory bidding requirements regarding the repair to Well 17 are waived because of the existence of the emergency. The City Manager is authorized to execute a contract or contracts to repair Well 17 without seeking competitive bids. ATTEST: • Ronald R. Cone, Finance Director
