A RESOLUTION AMENDINGRESOLUTION 1307 SETTING FORTH A POLICY WITHREGARDTOTHEPROVISIONOFWATERAND/OR SEWER UTILITIESOUTSIDETHECORPORATELIMITSOFTHECITYANDSETTINGFORTHANANNEXATIONPOLICY
FOR THE CITY OF MOSESLAKE,WASHINGTON
Recitals:
1.Previously the City Council adopted Resolution #1307 setting forth a policy with regard to theprovisionofwaterand/or sewer utilitiesoutside the corporate limits of theCityand settingforth anannexationpolicyfortheCityofMosesLake,Washington.
2.That policy is now amended,without repeal,by thisresolution settingforth a policywith regard to theprovisionofwaterand/or sewer utilitiesoutside thecorporate limits of the Cityand setting forth anannexationpolicyfortheCityofMosesLake,Washington.
Resolved:
1.The followingdefinitions shallbe applicabletothetermsused in thisresolution,
Contiguous Lands means any lands touchingorabuttingthe corporate limitsof theCityand any lands
withinone half mile of thecorporate limitsof the City as measured at the point the corporate limits
and the involved lands are closest together.
Non-Contiguous Lands means any lands beyond one half mile of thecorporate limits of theCity asmeasuredatthepointthecorporatelimitsandtheinvolvedlandsareclosesttogether.
Provision.Delivery,or Fumishing City Water and/or Sewer Utilities means theextension of water
and/or sewer mains,or tapping into an existingwater and/or sewer main by a lateral to serve acustomer,or the expansion of an existing water and/or sewer use,or any combination of these.
CityWater means potable water delivered from the water utilitysystem operated by the City.
CitySewer means the sanitary sewerage collection utilitysystem operated by the City.
CitvUtilityServiceorWater and/or Sewer Utilitiesmeans Citywater and/or City sewer.
Adjacent Lands means any lands located immediately adjacent to a citywater and/or citysewer main
withinthe city'sUrban Growth Area (UGA)andwhichlands are contiguouslands as defined herein.
2.Requests for Extensions:The Moses Lake CityCouncil shall review all requests for theprovision of
water andlor sewer utilities whether the request involves propertywhich is contiguous or non-contiguous.OnlytheCityCouncilcan grant permissionfor the provision,delivery,orfurnishing ofwaterand/orsewer utilitiestoanyonebeyondthecorporate limitsoftheCity,such permissionbeingevidencedbyaformalcommitmentnotedintheminutesofaregularCityCouncilmeeting.AII
extensionsofwaterand/orsewer utilitiesbeyond thecorporatelimitsofthe Cityshallbe made by theCityCouncilwithintheirsoleandcompletediscretion.
3.Delivery of City Water and/orSewer UtilitiestoContiguous Lands:
A.The Cityof Moses Lake willonly deliver water and/or sewer utilitiesto contiguous lands iftheownerofthoselandsannexesthoselandsintotheCity,except,ifthe public'shealth,safety,and welfare is an issue,as determined by the Grant County Health District,theCity maydeliverCitywaterand/or City sewer utilitiessubject tothesame conditionsapplicable tothedeliveryofCitywaterand/or Citysewer utilitiestonon-contiguouslands.Once withinthe CitythelandswillbedeliveredCityutilitiesasprovidedbyCityordinance.IfthosecontiguouslandsarenotannexedintotheCity,the Citywilldeliver neither Citywater nor City sewerservices,except as set forth insubsection b below.
B.The CityCouncil may permit the provisipn ofwater and/or sewer service to adjacent landswherethewaterand/or sewer main is adjacent to the property,the property is contiguous
lands as defined in this resolution and itis impractical for the property owner toannex theOowner's property into the city because of the previous subdivision of the land or other likecondition.Each such request willbe considered bytheCityCouncil on an individualbasisandnouniformresultasrespectssuchrequestsisexpectedwhereeachwillbedeterminedbytheuniquecircumstanceofeachpropertyseekingpermissiontoconnecttocitywaterand/orsewer.Ifthe CityCouncilpermits adjacent lands toconnecttothecitywater and/orsewersystem,the propertyownershallfirst complywith the procedure for the delivery ofwaterand/orsewer tonon-contiguous lands as set forth below in Section 4.
4.DeliveryofCitvWater and/or Sewer Utilitiesto Non-Contiquous Lands:The CityofMoses Lake willconsidertheprovisionofwaterutilitiesand/or the provision of sewer utilitiestonon-contiguouslandswhensuchwaterisavailableorwhensuchseweragecapacityisavailableasdeterminedbytheCity
Councilin theCitysewerage system upon the conditions listed below:
A.The execution of a contract document between the land owner and the City containing theessentialelementsofthewaterand/or sewer provision agreement as outlined below.
B.The water and/or sewer system to be built and connected to the City water utilityor City
sewer utilitywillbe builtto Citystandards.
C.The execution of necessary document(s)as determined by the City's legal department from
the land owner to the City stating in essence thatthe land owner agrees to have non-contiguous lands annexed to the City at the City's discretion when those lands can be
annexed.
Further,thedocument(s)willprovideas a condition of receiving City water and/or Citysewerthatthenon-contiguous lands willnot be used in any manner inconsistent withthe City's
Comprehensive Land Use Plan.
D.The land owner willsurvey the non-contiguous lands to be provided Citywater and/orCity
sewer ifrequested to do so by City staff.
E.The Citywater and/or sewer utilityservices providedtothe non-contiguous land willnot be
changed as to either thescope,nature,or intensity of the use without further approval from
the Moses Lake CityCouncil as such change is considered an expansion of thecommitment
given unless such expansion has already been provided for inthecommitment givenby the
Moses Lake CityCouncil.
E Such other conditions as City staffmay negotiateas being necessary and as approved by
theMoses Lake CityCouncil.
G.Failure tocomply with any of the conditions ofthewater and/orsewer provision agreement
shall terminatethe delivery of water and/orsewer utilityservices to the non-contiguous land.
5.Any formal commitmentgiven by theCityCouncil to provide water and/or sewer utilitiesoutside the
corporatelimits oftheCityshall remain in effect for two(2)years from thedate the commitment is
given.Within thetwo(2)year commitmentperiod,thelands involved must actually be tapped intotheCity's water and/orsewer utilitiesor the commitment given by the City Council shallbe consideredautomaticallywithdrawnwithoutfurtherconsiderationbytheCityCouncil.Anydocuments prepared
and delivered by a party pursuant toSection4.a.and c.shallbe retumedtothe land owner ifthe
commitment is terminated.
Effective Date:This policy shall control all extensions of City water and sewer utilities after September 24,
1985.
