A RESOLUTION REGARDINGTHEMOSES LAKESPRING FESTIVALTO BE HELD
MAY22,23,24,25,and 26,2003
RECITALS:
1.The Moses Lake Spring Festival Committee has organized a Spring Festival for the Cityof Moses Lake
to occuron May 22,23,24,25,and 26,2003.
2.The CityofMoses Lake endorses theMoses Lake Spring Festival concept.
RESOLVED:
1.The Moses Lake Spring Festival shallbe allowedto use citypropertyand streets for its Festival relatedactivities;i,e,a carnivalso long as itdoes notobstructany right-of-way,food fair,craftshow,and relatedactivitiesatMcCoshPark,a 10K -5K run,a canoe race that would cross over Cascade Valley Park,Peninsula Park,Montlake Park,and McCosh Park,the use of the amphitheater during the festival,parades that wouldutilizecitystreets,a car show at the Civic Center Park,a pickle ball contest andcompetitiononThirdAvenue,and a 3 on 3 basketball tournamentutilizinga parkinglot and four tenniscourtsatMcCoshPark.
2.The CityCouncilof the City of Moses Lake approves of street barricading for the parade and otherFestivalrelatedactivitiesasisrequiredbytheMosesLakeSpringFestival,including a sidewalk salesponsoredbytheMosesLakeBusinessAssociationheldinconjunctionwiththeMosesLakeSpringFestival,to be set forth in a letter to the City Manager.Discussions with regard to street barricading
should be held with theMoses Lake Police Chief or his designee so thatitis understood when and wherebarricadingistotakeplace.Responsibility for obtainingand setting barricades shall remain with theMosesLakeSpringFestivalorMosesLakeBusinessAssociationunlessotherwiseagreeduponwiththeMosesLakePoliceChieforhisdesignee.
3.The city shall absorb the in-kind financial expenses for policeand security services,street sweeping,garbage pick-up and solid waste dumping fees.The garbage pick-up,solidwaste dumping fees and theexpenseforstreetsweepingandpoliceandsecurityservicesabsorbedbythecityisconsideredanadditionalexpenseofprovidingcityservicesduringtheperiodtheFestivaltakesplace.
4.Ifthere are any special requests tosupply water,itwillbe the decision of theMunicipalServices Director
as to the charges tobe assessed.
5.Parking shall be prohibited along parts of the parade route,such parade totakeplace on May24,2003foraperiodoftimedeterminednecessarybytheMosesLakePoliceChieforhisdesigneeandtheMosesLakeSpringFestivalCommittee.The parking prohibition is authorized by Moses Lake Municipal Code10.12.020 and the prohibition notification shall conform to said Municipal Code provision.
6.The Moses Lake Spring Festival shallprovide liabilityinsurance inamounts and withthe typeofcoveragerequestedbytheCityManagerwiththeCityofMosesLakebeingnamedasanadditionalnamedinsured.
7.TheMoses Lake Spring Festival shall execute an indemnity/hold harmless agreement wherebytheMosesLakeSpringFestivalshallholdtheCityofMosesLakeharmlessfromanyclaimsfordamageandindemnifytheCityofMosesLakefromanyliabilitywhichmayariseasaresultoftheMosesLakeSpringFestivalusinganycityproperty,public streets,or public sidewalksfor any Festival related a ativity.
