2600_00001RESOLUTION NO.2600 ARESOLUTION REGARDINGTHE MOSES LAKESPRING FESTIVALTOBEHELDMAY27,28,29,30 and 31,2004 RECITALS: 1.The Moses Lake SpringFestival Committee has organizeda SpringFestival for the Cityof Moses LaketooccuronMay27,28,29,30,and 31,2004. 2.The City of Moses Lake endorses the Moses Lake Spring Festival concept. RESOLVED: 1.The Moses Lake Spring Festival shallbe allowed to use city property and streets for its Festival relatedactivities;i.e.a carnival so long as itdoes not obstruct any right-of-way,food fair,craft show,and relatedactivitiesatMcCoshPark,a 10K -5K run,a canoe race that would cross over Cascade Valley Park,Peninsula Park,Montlake Park,and McCosh Park,the use of the amphitheater during the festival,parades that wouldutilize city streets,a car show at the Civic Center Park,a pickle ball contest andcornpetitiononThirdAvenue,and a 3 on 3 basketball tournarnentutilizinga parkinglot and four tenniscourtsatMcCoshPark. 2.The City Council of the City of Moses Lake approves of street barricading for the parade and otherFestivalrelatedactivitiesasisrequiredbytheMosesLakeSpringFestival,including a sidewalksalesponsoredbytheMosesLakeBusinessAssociationheldinconjunctionwiththeMosesLakeSpringFestival,to be set forth in a letter to the City Manager.Discussions with regard to street barricadingshouldbeheldwiththeMosesLakePoliceChieforhisdesigneesothatitisunderstoodwhenandwherebarricadingistotakeplace.Responsibility for obtainingand setting barricades shall remain with theMosesLakeSpringFestivalorMosesLakeBusinessAssociationunlessotherwiseagreeduponwiththeMosesLakePoliceChieforhisdesignee. 3.The cityshall absorb the in-kind financial expenses for police and securityservices,street sweeping,garbage pick-up andsolid waste dumping fees.The garbage pick-up,solid waste dumping fees and theexpenseforstreetsweepingandpoliceandsecurityservicesabsorbedbythecityisconsideredanadditionalexpenseofprovidingcityservicesduringtheperiodtheFestivaltakesplace. 4.Ifthere are any special requests tosupply water,itwillbe the decision of the Municipal Services Directorastothechargestobeassessed. 5.Parking shall be prohibited along parts of the parade route,such parade totakeplace on May29,2004foraperiodoftimedeterminednecessarybytheMosesLakePoliceChieforhisdesigneeandtheMosesLakeSpringFestivalCommittee.The parking prohibition is authorized by Moses Lake Municipal Code10.12.020 and the prohibition notification shall conformtosaid Municipal Code provision. 6.The Moses Lake Spring Festival shall provide liabilityinsurance in amountsand with thetypeofcoveragerequestedbytheCityManagerwiththeCityofMosesLakebeingnamedasanadditionalnamedinsured, 7.The Moses Lake Spring Festival shall execute an indemnitylhold harmless agreement whereby theMosesLakeSpringFestivalshallholdtheCityofMosesLakeharmlessfromanyclaimsfordamageandindemnifytheCityofMosesLakefromanyliabilitywhichmayariseasaresultoftheMosesLakeSpringFestivalusinganycityproperty,public streets,or public sidewalks for any Festival related activity.
