2651_00001RESOLUTION NO.2651 A RESOLUTION AUTHORIZING THE CITY OF MOSES LAKETO APPLY FOR ACOMMUNITYDEVELOPMENTBLOCKGRANT RECITALS: 1.The City of Moses Lake is applying to the state Department of Community,Trade and Economic Development for funding assistance. 2.It is necessary thatcertain conditions be met as part of the application requirements; 3.Joseph K.Gavinski,Citymanager,is authorizedtosubmit thisapplication tothe State of Washington onbehalfoftheCityofMosesLake. RESOLVED: 1.The City Council of the City of Moses Lake,authorizes submission of this application to the state Department of Community,Trade and Economic Developmentto request $1,000,000.00to extend city sanitary sewer main lines,install side service lines,and connect housing to city sewer service,all inLongviewTractsarea,and certifies that,iffunded,it: A.Willcomplywith applicableprovisions of Title i of theHousing and Community Development Actof1974,as amended,and other applicable state and federal laws; B.Has provided opportunities for citizen participation comparable to the state's requirements (thosedescribedinSection104(a)(2)(3)of the Housing and Community Development Act of 1974,asamended);has complied with allpublic hearing requirements and provided citizens,especially low.and moderate-income persons,with reasonable advance notice ofandthe opportunitytopresenttheirviewsduringtheassessmentofcommunitydevelopmentandhousingneeds,during thereviewofavailablefundingandeligibleactivities,and on the proposed activities; C.Has provided technicalassistance to citizens and groups representative of low-and moderate-income persons thatrequest assistance in developing proposals; D.Willprovide opportunities for citizens to review and comment on proposed changes inthe funded project and program performance; E.Willnotuse assessments against properties owned and occupied by low-and moderate-income persons or charge user fees to recover the capital costs of CDBG-funded public improvements from low-and moderate-income owner-occupants; F.Willestablisha plan tominimize displacement as a result of activities assisted withCDBG funds; and assist persons actuallydisplaced as a result of such activities,as provided in the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970,as amended; G.Willconduct and administer its program in conformance withTitleVIofthe CivilRights Actof 1964andtheFairHousingAct,and willaffirmatively further fair housing (Title Vill oftheCivilRights Act of 1968);and has adopted (orwilladopt)and enforce a policy prohibiting the use of excessiveforcebylawenforcementagencieswithinitsjurisdictionagainstanyindividualsengagedin nonviolent civilrights demonstrations;and has adopted (orwill adopt)and implement a policy ofenforcingapplicablestateandlocallawsagainstphysicallybarringentrancetoorexitfromafacilityorlocationthatisthesubjectofsuchnonviolentcivilrightsdemonstrationwithinits jurisdiction,in accordance with Section 104(1)of the Title I of the Housing and Community Development Act or 1974,as amended;and H.Willprovide,upon request,and prior to any obligation of funds being made,a complete and accurate CDBG Federal Funds Disclosure Report detailing the required applicant/granteeinformationand,as appropriate,other government assistance provided or applied for,interestedpartiesandexpectedsources,and uses of funds. 3.The City Council of the City of Moses Lake designates Joseph K.Gavinski,City Manager,as theauthorizedChiefAdministrativeOfficialandtheauthorizedrepresentativetoactinallofficialmattersin O connection with this application and the City of Moses Lake's participation in the State of WashingtonCDBGProgram.
