A RESOLUTION TO ACCEPT AN EASEMENT TO THE CITY OF MOSES LAKE
FROM KEN BULEY
Recitals:
1.Resolution No. 238 provides that all grants of real estate, or any interest therein, to the
City of Moses Lake, shall not be accepted until a resolution has been duly passed by the
City Council.
2.Ken Buley has presented an easement to the City of Moses Lake.
Resolved:
1. An easement for municipal purposes for the following described property is hereby
accepted by the City of Moses Lake:
A PORTION OF FARM UNIT 123, IRRIGATION BLOCK 41, IN SECTION 25, TOWNSHIP
19 NORTH, RANGE 28 EAST, W.M., GRANT COUNTY, WASHINGTON, MORE FULLY
DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHEAST CORNER OF SAID FARM UNIT 123; THENCE
N89°25'29"W ALONG THE NORTH BOUNDARY OF SAID FARM UNIT 123, A DISTANCE
OF 2395.51 FEET TO THE TRUE POINT OF BEGINNING; THENCE S00°34'31 "W, 22.00
FEET; THENCE N89°25'29"W PARALLEL WITH THE NORTH BOUNDARY OF SAID
FARM UNIT 123, A DISTANCE OF 29.57 FEET; THENCE S84°23'32"W, 171.37 FEET TO
THE SOUTHWEST BOUNDARY OF SAID FARM UNIT 123; THENCE N38°54'06"W
ALONG THE SOUTHWEST BOUNDARY OF SAID FARM UNIT 123, A DISTANCE OF
52.41 FEET TO THE NORTHWEST CORNER OF SAID FARM UNIT 123; THENCE
S89°25'29"E ALONG THE NORTH BOUNDARY OF SAID FARM UNIT 123, A DISTANCE
OF 233.27 FEET TO THE TRUE POINT OF BEGINNING.
TOGETHER WITH RIGHT OF USE THE EXISTING TYPE B (FARM USE) ACCESS AT
STATION HIGHWAY 10+52 AND THE ACCESS PERMIT FROM SAID ACCESS POINT TO
THE NORTH BOUNDARY OF FARM UNIT 123 FOR MAINTENANCE OF CITY
UTILITIES AS LONG AS THE TYPE B FARM ACCESS AND PERMIT ARE ACTIVE
UNDER WSDOT PERMITS.
To have and to hld said easement and rights unto the Grantee and its assigns forever. The
easements shall run with the land.
