Richard Pearce, Deputy Mayor • RESOLUTION NO. 2778 •A RESOLUTION INITIATING THE PROCEDURE FOR VACATING RIGHT-OF-WAY DEDICATED FOR THE DEVELOPMENT OF TOEVS AVENUE RECITALS: 1.There exists right-of-way dedicated for the development of Toevs Avenue. 2.RCW 35.79 provides that a public street may be vacated upon resolution initiated and passed by the legislative authority of the jurisdiction where the street is situated and that such resolution shall fix a time when the petition will be heard and determined and which shall not be more than sixty days nor less than twenty days after the passage of such resolution. RESOLVED: 1.The vacation of the following described public right-of-way shall be initiated: A parcel in the Southwest 1/4 of Section 22, Township 19 North, Range 28 East W.M., City of Moses Lake, Grant County, Washington, described as follows: That portion of Toevs Avenue as shown on the First Presbyterian Church Plat, per Grant County Auditor plat records, book 7, page 56, being coincident to Lots 2 through 6, lying north of the C Street north right- of-way line and south of the B Street south right-of-way line. 2.A public hearing before the City Council shall be set for July 25, 2006; the first reading of a vacation ordinance shall be set for July 25, 2006; and a second reading of a vacation ordinance shall be set for August 8, 2006.
