Cone, Finance Director • RESOLUTION NO. 2793 A RESOLUTION ACCEPTING STREET AND UTILITY IMPROVEMENTS FOR MUNICIPAL USE AS PART OF THE SIXTH AVENUE CONSTRUCTION PELICAN HORN APARTMENTS Recitals: 1.Street and utility improvements, lying in dedicated right-of-way or easements, are in place and connected to the City of Moses Lake's street and utility systems as part of the Sixth Avenue Construction Pelican Horn Apartments 2.Said street and utility improvements have been installed in accordance with the City of Moses Lake's Community Standards, such installation being completion in September, 2006. 3.RCW 35.91.030 indicated that public street and utility facilities, which are developer installed, should be accepted by the City of Moses Lake upon completion if the facilities are built to city standards. Resolved: • 1. The City Council of the Moses Lake accepts the street and utility improvements as facilities of the City of Moses Lake and as such will charge for use of such facilities as authorized by ordinance. 2. After September 12, 2007, all further maintenance and operation cost of said street and utility improvements, shall be borne by the City of Moses Lake, as provided by city ordinance.
