RESOLUTION NO. 2868
A RESOLUTION SUPPLEMENTING THE POLICY ESTABLISHED IN
RESOLUTION 1307 AND AMENDED IN RESOLUTION 2513 RELATING TO THE
PROVISION OF WATER AND/OR SEWER UTILITIES OUTSIDE THE
CORPORATE LIMITS OF THE CITY AND ANNEXATIONS
RECITALS:
1.The City Council has previously established a policy with regard to the provision of water
and/or sewer utilities outside the corporate limits of the city and setting forth an annexation
policy for the city in Resolution No. 1307. That policy was amended in Resolution No. 2513.
2.The City Council desires to supplement that policy to provide guidance to City Council and
staff and those seeking a waiver of the requirement to provide for city water and/or sewer
utilities for their project or development within the city's urban growth area.
RESOLVED:
1. Definitions: The following definitions shall be applicable to the terms used in this resolution:
A.All definitions from Resolution No. 2513 shall apply in this resolution.
B.Urban Growth Area means the city's urban growth area as defined in the most current
adopted Grant County comprehensive land use plan.
C.Grant County Development Code means the ordinances and resolutions of Grant
County, as now adopted or hereafter amended, which apply to development within the
city's urban growth area.
D.Platting Improvement Waiver means a document provided from the city to Grant
County establishing that a project or development located within the city's urban growth
area may proceed without the proponent constructing improvements by either
connecting to the city's water or sewer or installing street improvements to city
standards, or posting a cash amount to guarantee the future costs of such
improvements.
2. Requests for Platting Improvement Waivers:
A. All requests for platting improvement waivers shall be processed by City Council or
staff in accordance with this resolution and Resolution No. 1307, as amended by
Resolution No. 2513. The City Council or staff shall require the execution of a covenant
running with the land or other agreement concerning the installation of the subject
improvements and the policy of this resolution as a condition of the delivery of such
waiver to Grant County unless in unique circumstances such a covenant running with
the land or other agreement is not appropriate.
B. In reviewing developments located within the city's urban growth area to determine if
a platting improvement waiver should be issued, the City Council or staff shall only
issue such a waiver if the covenant running with the land or other agreement
concerning the installation of the subject improvements and the policy of this resolution

is appropriate and if other urban development concerns are addressed. Those
additional concerns relating to development within the city's urban growth area are in
part:
1)Assurances that the source of potable water is lawful in accordance with the laws
of this state.
2)Assurances that the source of potable water is appropriate and consistent with water
delivery planning agreements and laws.
3)Assurances and protections that the location of proposed roads, wells, septic tanks,
lots lines or other infrastructure shall not create barriers to the installation of city
water and sewer mains, and the extension of city streets.
4)Assurances that the re-division of large lots to urban densities can be accomplished
from the plat proposed.
