2922RESOLUTION NO. 2922 A RESOLUTION INITIATING THE PROCEDURE FOR VACATING RIGHT- OF-WAY DEDICATED FOR THE DEVELOPMENT OF A PORTION OF FOURTH AVENUE AND BALSAM STREET RECITALS: 1.There exists right-of-way dedicated for the development of a portion of Fourth Avenue and Balsam Street. 2.RCW 35.79 provides that a public street may be vacated upon resolution initiated and passed by the legislative authority of the jurisdiction where the street is situated and that such resolution shall fix a time when the petition will be heard and determined and which shall not be more than sixty days nor less than twenty days after the passage of such resolution. RESOLVED: 1. The vacation of the following described public right-of-way shall be initiated: A portion of Balsam Street and Fourth Avenue located in the Northwest 1/4 of Section 23, Township 19 North, Range 28 East W.M., City of Moses Lake, Grant County, Washington, described as follows: Commencing at the north corner of Lot 14, Block 17, Plat of Neppel, as recorded in Grant County Auditor plat records, book 2, page 66, thence South 36°19'06" East, 10.46 feet, along the northeasterly line of said Lot 14, to the point of beginning; thence along a 57.00 foot radius non-tangent curve concave to the north, an arc of 113.21 feet, the chord being North 20°34'50" East, 95.50 feet, to the northeasterly line of Balsam Street, formerly Birch Street, as shown on the Plat of Neppel; thence South 36°19'06" East, 263.38 feet, along said northeasterly line; thence along a 57.00 foot radius curve concave to the south, an arc of 113.21 feet, the chord • being South 86°46'58" West, 95.50 feet, to the southwesterly line of Balsam Street; thence North 36°19'06"West, 159.07 feet along said southwesterly line, to the point of beginning and; Fourth Avenue lying coincident to Block 17 and 18, Plat of Neppel, and coincident to the northeasterly line of Alder Street and the southwesterly line of Balsam Street formerly Birch Street as shown on the Plat of Neppel; reserving the following easements: A 20.00 foot wide Public Utility Easement described as follows: Beginning at the east corner of Lot 12, Block 17, Plat of Neppel, thence South 36°19'06" East, 80.00 feet; thence North 53°40'54" East, 20.00 feet; thence North 36°19'06" West, 80.00 feet; thence South 53°40'54" West, 20.00 feet to the point of beginning, and; A 10.00 foot wide Cascade Natural Gas Easement described as follow: Commencing at the south corner of Lot 13, Block 17, Plat of Neppel, thence South 36°19'06" East, 0.50 feet, to the point of beginning; thence North 53°40'54" East, 140.50 feet; thence North 36°19'06" West, 39.82 feet; thence along a 57.00 foot radius non-tangent curve concave to the north, an arc of 10.53 feet, the chord being North 71°38'25" East, 10.51 feet; thence South 36°19'06" East, 46.58 feet; thence South 53°40'54" West, 150.50 feet; thence North 36°19'06" West, 10.00 feet, to the point of beginning, and; A 10.00 foot wide Cascade Natural Gas and Qwest Telephone easement described as follows: Commencing at the south corner of Lot 12, Block 17, Plat of Neppel, thence South 36°19'06" East, 0.50 feet, to the point of beginning; thence North 53°40'54" East, 140.00 feet; thence South 36°19'06" East, 10.00 feet; thence South 53°40'54" West, 140.00 feet, to the northeast-• erly line of Alder Street; thence North 36°19'06" West, 10.00 feet, to the point of beginning. • ald R.
