1984u u u RESOLUTION NO.1984 A RESOLUTION INITIATING THE PROCEDURE FOR VACATING RIGHT-OF-WAY ON COMMERCIAL AVENUE RECITALS: 1.The owners of a portion of the property abutting upon the public right-of-way of a portionof Commer cial Avenue have requested its vacation. 2.RCW 35.79 provides that a public street may be vacated upon resolution initiated and passed by the legislative authority of the jurisdiction where the street is situated and that such resolution shall fix a time when the petition will be heard and determined and which shall not be more than sixty days nor less than twenty days after the passage of such resolution. RESOLVED: 1.The petition forthe vacation of the following described public right-of-way shall be accepted: That portionof Commercial Avenue located in the SWA of Section 14,Township 19 North,Range 28 East, W.M., Grant County,Washington described as follows: Commencing at the northeast corner of the 0.67 acre tract shown on Les Schwab Tires Short Plat recorded in Book 4 of Plats,Pages 16 and 17, the True Point of Beginning;thence South 44°45'45" West along the northerly boundary of said 0.67 acre tract, 125.24 feet to the most easterly point of a cul-de-sac shown on said short plat as "Dedicated to city for road r/w", a point on a non-tangent curve (radial bearing South 74°43'53"West);thence southwesterly and northwesterly along said road dedication and along said non-tangent curve being concave to the northwest and having a radius of 40.00 feet and a delta of 120°03'47"a distance of 83.82 feet returning to a point on the northerly boundary of said 0.67 acre tract (radial bearing North 14°47'40"East);thence South 44°45'45"West along said northerly boundary 8.16 feet to the most northwesterly corner of said 0.67 acre tract, said point also lying on the northeasterly boundary of Tax Lot Number 6710 as shown on the Record of Survey recorded in Book 34 of Surveys,Pages 4 and 5;thence North 37°13'20"West along the northeasterly boundary of Tax Lot Number 6710 a distance of 60.59 feet to the most northerly corner of Tax Lot Number 6710,said point lying on the southeasterly boundary of Tax Lot Number 5878 also shown on said Record of Survey;thence North 44°45'45"East along the southeasterly boundary of Tax Lot 5878 a distance of 143.42 feet to the most easterly corner of the Boundary Line Adjustment shown on said Record of Survey recorded in Book 34 of Surveys,Pages 4 and 5 (said point lies South 44°45'45"West,6.58 feet from the most easterly corner of said Tax Lot Number 5878);thence South 85°30'43"East,78.64 feet to the True Point of Beginning;containing 11,367 square feet. 2.The first reading of a vacation ordinance shall be set for September 10,1996; that a public hearing before the Planning Commission shall be set for August 29,1996;and that a second reading of a vacation ordinance shall be set for September 24,1996.
