A RESOLUTION INITIATING THE PROCEDURE FOR VACATING A PORTION OF
COMMERCIAL AVENUE
RECITALS:
1. The owners of more than two-thirds of the property abutting upon the sixty foot public right-of-way
dedicated as part Neppel Plat.
(J 2.RCW 35.79 provides thata public streetmay be vacated upon resolution initiated and passed by the
legislative authority ofthe jurisdiction wherethe streetis situated andthatsuch resolution shall fix atime
whenthe petition will be heardand determined andwhich shall not be morethan sixtydays norless
than twenty days afterthe passage of such resolution.
RESOLVED:
1.The petition for the vacationof the following described public right-of-way shall be accepted:
That portion of Section 14 Township 19 North, Range 28 EWM described as follows:
Beginning atthe intersection ofthe centerline of Broadway andthe centerline ofChestnut Streetof the
Cityof Moses Lake,Washington,as shown on the Plat of Neppel,filed October 15,1912 thence north
53°42*00"east, a distance of 40*along the centerline of Broadway;thence north 36°18'00"west, a
distance of 220.11';thence north 44°45*45"east a distance of 100*;thence south 37°12*59"east a
distance of 60.58'to the true pointof beginning;thence continuingsouth 37°12*59"east a distance of
15.07';thence south 36°18*00"east, a distance of 5.14'to a point on the southeasterly right-of-wayof
Commercial Avenue;thence north 44°45'45" east, along said right-of-way a distance of 202.24'to a
pointonthe southwesterlyright-of-way of DateStreet;thence north36°18*00"west adistance of 20.25';
thence south 44°45*45"west a distance of 202.00' to the true point of beginning;describing a strip of
land 20' wide, lying northwest and adjacent to the southeasterly right-of-way of Commercial Avenue;
containing 0.0928 acres,more or less.

2.The firstreading of a vacation ordinance shall be set for June 12,1990;that a public hearing before the
Planning Commission shall be set for May 24,1990;and that a second reading of a vacation ordinance
shall be set for June 26,1990.
