A RESOLUTION DIRECTING RECONSTRUCTION OF SIDEWALK LOCATED ON AND
ABUTTING PROPERTY LEGALLY DESCRIBED AS THE PLAT OF NEPPEL,BLOCK
11,LOTS 1 AND 2,AS THEY FRONT ON BROADWAY AVENUE AND BALSAM
STREET,BLOCK 21,LOTS 13 THROUGH 24 AS THEY FRONT ON ALDER
STREET,THIRD AVENUE,AND DIVISION STREET;BLOCK 26,THE NORTHERLY
24.29 FEET OF LOT 24 AS IT FRONTS ON DIVISION STREET;BLOCK 31,
THE NORTHERLY 90 FEET OF LOTS 1 THROUGH 6 AND LOTS 7 THROUGH 8 AS
THEY FRONT ON ASH STREET AND BROADWAY AVENUE AND LOT 12 AS IT
FRONTS ON BEECH STREET;BLOCK 36,LOTS 2 THROUGH 12 AS THEY FRONT
ON BROADWAY AVENUE AND CEDAR STREET;BLOCK I,LOTS 1 THROUGH 13 AS
THEY FRONT ON BROADWAY AVENUE;GUFFIN TRACT,BLOCK 32,LOT 13 AS
IT FRONTS ON THIRD AVENUE AND LOTS 1 THROUGH 8 AS THEY FRONT ON
THIRD AVENUE AND ASH STREET;AND GUFFIN TRACT 2,BLOCK 37,LOT 1
AS IT FRONTS ON THIRD AVENUE AND REQUIRING THE ABUTTING PROPERTY
OWNERS TO PAY A PORTION OF THE COSTS
RECITALS:
1.The City of Moses Lake is planning to install new street lighting in the
area bounded by Broadway Avenue and Third Avenue between the southwest
side of Alder Street and the northeast side of Cedar Street.
2.As part of the project,new conduit will be installed where it currently
does not exist and pads will be constructed for the street lights.The
project will involve removing concrete sidewalk in areas where pavers
have not been installed.
3.A map visually illustrating the area of the project is attached to this
resolution and incorporated by reference herein.
4.That sidewalk in the project area which is not constructed with city
approved pavers will be replaced with the approved pavers.
M 5.The city has the authority to construct,reconstruct,and repair
sidewalks and gutters and curbs along and driveways across sidewalks and
to assess all or any portion of the costs against the abutting property
owner pursuant to RCW 35A.11.020 and RCW 35.68.
RESOLVED:
1.The resolution supercedes Resolution #1644 passed by the City Council on
October 8,1991.
2.The property owners of the property legally described as the Plat of
Neppel,Block 11,Lots 1 and 2,as they front on Broadway Avenue and
Balsam Street,Block 21,Lots 13 through 24 as they front on Alder
Street,Third Avenue,and Division Street;Block 26,the northerly 24.29
feet of Lot 24 as it fronts on Division Street;Block 31,the northerly
90 feet of Lots 1 through 6 and Lots 7 through 8 as they front on Ash
Street and Broadway Avenue and Lot 12 as it fronts on Beech Street;
Block 36,Lots 2 through 12 as they front on Broadway Avenue and Cedar
Street;Block I,Lots 1 through 13 as they front on Broadway Avenue;
Guffin Tract,Block 32,Lot 13 as it fronts on Third Avenue and Lots 1
through 8 as they front on Third Avenue and Ash Street;and Guffin Tract
2,Block 37,Lot 1 as it fronts on Third Avenue shall be assessed a
portion of the cost of replacing concrete sidewalk with pavers,
according to the cost sharing arrangement between the City of Moses Lake
and the property owners as ordered by the Moses Lake City Council and as
(i set forth in the preliminary established assessments.
3.A hearing on this resolution shall be held during the regular City
Council meeting on November 12,1991 which begins at 8 p.m.in the
Council Chambers in the Police/Court Facility in the City of Moses Lake.
4.This resolution shall be published in the official newspaper of the city
on two consecutive weeks prior to the public hearing on the resolution
and a notice of the date of the hearing shall be mailed to the abutting
property owners or reputed owners of the property as shown on the tax
rolls of the County Treasurer at least ten days before November 12,
A preliminary assessment roll has been prepared under the direction of
the Municipal Services Director and has been filed with the Finance
Director which is based on the benefits received and which describes the
property assessed,the name of the owner or owners,if known,otherwise
stating that the owner is unknown,and preliminarily fixing the amount
of the assessment.
The final assessment roll will be prepared upon completion of the
project and after costs have finally been established and will be filed
with the Finance Director.A hearing on the final assessment roll will
be held by City Council after it has been filed with the Finance
Director.
