A RESOLUTION DECLARING AN EMERGENCY AND WAIVING THE STATUTORY
BIDDING REQUIREMENTS BECAUSE OF THE EMERGENCY
RECITALS:
1.The city owns and operates a municipal water system in an area outside the corporate limits of the
city generally known as the Larson Subdivision.
2. Ithas been documented and it is recognized that several of the municipal wells owned by the City of
Moses Lake in the Larson Subdivision area are tainted with trichloroethylene (TCE)in amounts which
exceed the Federal Safe Drinking Water Standards.
^_J 3.The City of Moses Lake,the Washington State Department of Ecology,the Washington State Depart
ment of Health,the United States Environmental Protection Agency,and the United States Army
Corps of Engineers have been studying the TCE contamination in the Larson Subdivision,attempting
to determine the source of the contamination,and examining the means and methods for eliminating
the contamination.
4. The City of Moses Lake has pumped tested the lower aquifer inWell 28. It has been determined
that ifthe upper water sources now entering Well 28 are prevented from entering the well, the TCE
contamination is reduced to withinthe Federal Safe Drinking Water Standards. The City of Moses
Lake, through its consultants,has determined that Well 28 can be rehabilitatedby sealing off the
upper water sources.
5. The Washington State Department of Ecology will not allow the use of Well 28 untilthe upper water
sources are prevented from entering the well.
6. The use of this well is necessary in order to meet summer water needs in the Larson Subdivision. It
is necessary,then,to get Well 28 back in operation as soon as possible or there will not be enough
water available in the Larson Subdivision to serve the population in the area. A memo to the City
Manager from the Municipal Services Directordated March 19,1992 with regard to Well 28, along
with a letter from the Washington State Department of Ecology dated March 19,1992 to the Munici
pal Services Director, Philip Bloom, also with regard to Well 28, are attached to this resolution and
incorporated by reference herein.

7. The cost to rehabilitateWell 28 in such a fashion as to make it usable and have it produce sufficient
water for the population in the Larson Subdivision area will cost between $100,000 and $150,000.
8. RCW 35.22.620(6) and RCW 35A.11.020 recognizes an exception to the bidding requirements for first
class cities and code cities in the event of an emergency.
RESOLVED:
1. An emergency exists in the Larson Subdivision area in as much as there may not be enough water
to supply the population in the area during the summer ifWell 28 is not rehabilitated as soon as
possible.The emergency exists for the reasons set forth in the recitals.
2. The statutory bidding requirements are waived because of the existence of the emergency. City staff
is authorizedto rehabilitate the wellwithout havingto formally seek competitive bids.
