A RESOLUTION AUTHORIZING THE CITY MANAGER TO GRANT AN EASE
MENT TO THELMA CROSS
1.Thelma Cross,property ownerof a portion of Lot 15,Block 7,Capistrano Park,has requested an
easement.
2. The easement is for access to Neppel Street.
RESOLVED:
1. The City Manager and Finance Director be authorized to execute an easement for the following
described property:
That portion of Neppel Street, as dedicated on Capistrano Park Plat filed on Page 8 in Book 4 of
Plats,Recordsof Grant County,Washington,locatedinthe northeastquarterofthe southeast quarter
of Section 28,Township 19 North,Range28 East,W.M.,Grant County,Washington,described as
follows:
Beginning at the intersection of the east line of the southeast quarter of said Section 28 and the
northwesterly right-of-way margin of said Neppel Street; thence south 44°27,20"west, along said
right-of-way margin,71.13 feet to the pointof curvaturefora 40.00 Footradiuscurve,concaveto the
south, the radius point of which bears south 45°32*40"east;thence along said curve, through a
central angle of 76°59,09°,an arc distance of 53.75 feet;thence north 0°30*40"east 44.66 Feet to
the true point of beginning.
Containing 0.02 acres,more or less.
This easement shall be subject to the following conditions:
A. This easement is given for the express purpose of allowing the Grantee access to Neppel
Street from propertydirectlyadjacent to propertywhere the easement has been granted.
B. The Grantee shall be responsible for maintaining the propertywhere the easement has been
granted. This easement reverts to the Grantor ifthe property where the easement has been
granted has not been maintained orifthe easement is used for purposes other than accessing
Neppel Street.
C. The Grantee is not permitted any new construction within this easement.
