A RESOLUTION WAIVING THE BIDDING REQUIREMENTS FOR PURCHASE OF
EQUIPMENT FOR A SKATEBOARD FACILITY OR PARK
RECITALS:
1.The Moses LakeCity Council has authorizedthe expenditure of up to $16,500 forthe purchase of
skateboarding equipment which will be placed on city supplied and owned property.
.j 2.The amount authorized and appropriated for skateboard equipment will allow for the purchase and
^-^installation ofnew equipment.
3. The equipment desired, after considerable investigation,is manufactured and sold by Fad-Tastic,
Brighton,Colorado.
4. The equipment manufactured and sold by Fad-Tastic uses steel coping and painted all metal and
wood surfaces.Fad-Tastic uses a special galvanized metal applied intheir own manner which is
paintedwith a reflective paintfor safety. This application provides fora smooth rideskating surface.
The equipment is described inthe attached sales literature which by this reference is incorporated
within this resolution.
5. The skateboarding equipment desired is available only through Fad-Tastic.
6.Through an inquiry and investigation conducted by the Moses Lake Park and Direction Director,
there is no other similar skateboarding equipment available from other manufactures and vendors,
and the skateboarding equipment manufactured by Fad-Tastic is sold only by Fad-Tastic directly.
7. Under the circumstances,special market conditions exist which requires waiving the bid require
ments set forth by statute for the purchase of materials and equipment.
RESOLVED:

1.The bid requirements for purchasing of materials and equipment set forth in RCW 35.23.352(6) and
RCW 35.23.352(A) are waived with regard to the purchasing of the new skateboarding equipment of
the type manufactured and sold by Fad-Tastic because of the special market conditions which exist.
2. The city staff is authorized to negotiate for the purchase of such a system without regard to the
requirements to go to bid.
