1788w RESOLUTION NO.1788 A RESOLUTION RELOCATING AN EASEMENT IN THE DESERT HIGHLANDS PHASE I PLAT RECITALS: 1.Resolution #238 provides that all grants of real estate,or any interest therein,to the City of Moses Lake, shall not be accepted until a resolution has been duly passed by the City Council. 2. The plat of Desert Highlands Phase Iwas approved by the City of Moses Lake and filed with the Grant County Auditor in Volume 14 of Plats,Pages 48 and 49. 3. A boundary line adjustment record survey affecting Lots 9 and 10, Block 3,Desert Highlands Phase I was filed on March 16, 1993,under Grant County Auditor's file number 930316017. 4. As a result of the boundary line adjustment the Public Utility Easement adjacent to Lots 9 and 10,Block 3,Desert Highlands Phase I should be relocated. 5. The City should abandon the previously dedicated easement for public utilities associated with Lots 9 and 10, Block 3,Desert Highlands Phase I. 6. Maiers Development Corporation has presented an easement to the Cityof Moses Lakewhich replaces the previously dedicated easement for public utilities associated with Lots 9 and 10, Block 3,Desert Highlands Phase I. RESOLVED: 1.The easement for public utilitiesalong the easterly 5 feet of Lot9 and the westerly 5 feet of Lot 10,Block 3,Desert Highlands,Phase I,as dedicated on the plat of Desert Highlands,Phase I,as filed in Volume 14 of Plats,Pages 48 and 49, of the records of Grant County,Washington,is abandoned by the City of Moses Lake. 2. An easement for public utilities,10 feet in width, lying 5' on either side of the following described line: Beginning at half inch rebar with survey's cap, marking the most northerly corner of Lot 9, Desert Highlands,Phase I,as per plat recorded in Volume 14 of Plats,Pages 48 and 49,records of Grant County, Washington, and the true point of beginning of said described line; then south 9°28'21" East, distance of 116.02 feet, to an intersection with the southeasterly boundary line of said Lot 9, and the terminus of said line,granted by Maiers Development Corporation, is accepted by the City of Moses Lake.
