RESOLUTION NO.1797
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOSES LAKE
DECLARING ITS INTENTION TO IMPROVE THE CRESTVIEW DRIVE AREA BY
CONSTRUCTING AND INSTALLING A SANITARY SEWER SYSTEM AND
CONNECTING THE SANITARY SEWER SYSTEM TO EXISTING SANITARY
SEWER IN THE PAXSON DRIVE AREA AND TO CREATE A UTILITY LOCAL IM
PROVEMENT DISTRICT TO ASSESS A PORTION OF THE COST AND EXPENSE
OF SAID IMPROVEMENTS AGAINST PROPERTY IN SUCH DISTRICT SPECIAL
LY BENEFITTED THEREBY AND TO NOTIFY ALL PERSONS WHO MAY
OBJECT TO SAID IMPROVEMENT TO APPEAR AND PRESENT THEIR OBJEC
TIONS AT A REGULAR MEETING OF THE CITY COUNCIL TO BE HELD ON
FEBRUARY 8,1994 AT 7 P.M.
1.A significant number of property owners,representing at least 50% of the amount of the assessed
valuation and representing more than 50%plus of the lineal front footage of the properties specially
benefitted by a proposed utility local improvement district (ULID)have presented petitions to the
Moses Lake City Council asking that the City Council initiate a ULID.The original of each petition
shall be filed with this resolution in the permanent legislative history files in the City of Moses Lake.
The Moses Lake City Council has accepted those petitions from a majority of the property owners
with property within the proposed Utility Local Improvement District.
2. A map outlining the proposed potential boundaries of the utility local improvement district which will
bear the cost of the improvements,shall be filed with this resolution in the permanent legislative
history files of the City of Moses Lake.
RESOLVED:
1.That it is the intent of the City Council of the City of Moses Lake to order the improvement of the
Crestview Drivearea by constructing and installing a sanitary sewer system and connecting the sewer
system to existing sanitary sewer in the Paxson Drive area.All of the foregoing shall be in accor
dance with the plans and specifications prepared under the direction of the City of Moses Lake.All
of the foregoing will be one continuous unit of the proposed improvement
2. That the improvement shall consist of extending a sewer main down Crestview Drive from the
intersection of Crestview Drive,Valley Road, and Airway Drive to the terminus of Crestview Drive and
then until such sewer main connects with an existing sewer main at the terminus of the sewer main
located in Paxson Drive extended.The properties specially benefitted shall include those legally
described as:

2.Crestview Estates No.2
3.Crestview Estates No.3
4.Crestview Estates No.4
5. SE 1/4 Section 16,T 19 N, R 28 E, WM
6. NE I/4 Section 21, T 19 N, R 28 E, WM
3. Theactual assessments mayvary from the assessment estimates so longas the assessments do not
exceed a figure equalto the increased true and fair value the improvement adds to the property.
4. That a portion of the entire cost and expense of said improvement in excess of $130,000 shall be
borne and assessed against the property specially benefitted by such improvement to be included
in the local improvement district to be established embracing as nearas may be all property specially
benefitted by such improvement.
5.That all persons who may desire to object to the improvement herein mentioned are hereby notified
to appearand present such objections ata meeting ofthe City Council in the Police/Court Building,
Moses Lake,Washington at 7 p.m.on February 8,1994,which time and placeare hereby fixed for
hearing all matters relating to said proposed improvement,and all objections thereto,and for
determining the method of paymentof said improvement.
6.The Municipal Services Director of the City of Moses Lake is hereby directed to submit to the City
Council on or prior to February 8,1994 all data and information required by law to be submitted.
