RESOLUTION NO.1882
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOSES LAKE
DECLARING ITS INTENTION TO IMPROVE THE CENTRAL DRIVE BE
TWEEN GRAPE DRIVE AND VALLEY ROAD,GRAPE DRIVE BETWEEN THE
END OF EXISTING WATER AND SEWER MAINS IN GRAPE DRIVE AND
HIGHWAY 17,CENTRAL PLACE, AND EVELYN DRIVE BETWEEN CREST
DRIVE ANDCENTRAL DRIVE AREA BY CONSTRUCTING AND INSTALLING
SANITARY SEWER AND WATER SYSTEM MAINS AND/OR EXTENSIONS,
AND CONNECTING WITH THE EXISTING WATER AND SANITARY SEWER
SYSTEMS AND TO CREATE A UTILITY LOCAL IMPROVEMENT DISTRICT
TO ASSESS THE COST AND EXPENSE OF SAID IMPROVEMENTS
AGAINST PROPERTY IN SUCH DISTRICT SPECIALLY BENEFITTED
THEREBY,AND TO NOTIFY ALL PERSONS WHO MAY OBJECT TO SAID
IMPROVEMENT TO APPEAR AND PRESENT THEIR OBJECTIONS AT A
REGULAR MEETING OF THE CITY COUNCIL TO BE HELD ON APRIL 25,
1995 AT 7 P.M.
1. A significantnumber of propertyowners, representing at least 50% of the amount of the assessed
valuation and representing more than 50% of the lineal front footage of the properties specially
benefitted by a proposed utility local improvement district (ULID)have presented petitions to the
Moses Lake City Council asking that the City Council initiate a ULID.The original of each petition
shall be filedwith this resolution in the permanent legislative history files in the City of Moses Lake.
The City Council has accepted those petitions from a majority ofthe property owners with property
within the proposed Utility Local Improvement District.
2. A map outlining the proposed potential boundaries of the utility local improvement district which will
bear the cost of the improvements,shall be filed with this resolution in the permanent legislative
history files of the City of Moses Lake.
RESOLVED:
1.That it is the intent of the City Council of the City of Moses Lake to order the improvement of the
^Central Drive between Grape Driveand Valley Road, Grape Drive between the end of existing water
[^J and sewer mains in Grape Drive and Highway 17,Central Place,and Evelyn Drive between Crest
Driveand Central Drive area by constructing and installing sanitary sewer and water system mains
and/or extensions and connecting with the existing water and sanitary sewer systems.All of the
foregoing shall be in accordance with the plans and specifications prepared under the direction of
the City of Moses Lake. All of the foregoing will be one continuous unit of the proposed improve
ment.
2. That the improvement shallconsist ofextending water and sanitary sewermains downCentral Drive
between Grape Drive and Valley Road,Grape Drive between the end of existingwaterand sewer
mains in Grape Drive and Highway 17, Central Place, and Evelyn Drive between Crest Drive and
Central Drive and connecting with the existing waterand sanitary sewer mains.The properties
specially benefitted shall include those legally described as:

3. That the actual assessments may vary fromthe assessment estimates so longas the assessments
do not exceed a figure equal to the increased true and fair value the improvement adds to the
property.
4. That the entire cost and expense of said improvement shall be borne and assessed against the
property specially benefitted by such improvement to be included in the utility local improvement
district to be established embracing as near as may be all property specially benefitted by such
improvement.
5. That all persons whomaydesire toobject to the improvement herein mentionedare hereby notified
to appear and present such objections at a meeting of the City Council in the Police/Court Building,
Moses Lake, Washington at 7 p.m. on April 25, 1995, which time and place are hereby fixed for
hearing all matters relating to said proposed improvement, and all objections thereto,and for
determining the method of payment of said improvement.
6. The Municipal Services Director of the City of Moses Lake is hereby directed to submit to the City
Council on or prior to April 25, 1995 all data and information required by law to be submitted.
