A RESOLUTION ESTABLISHING A DRUG AND ALCOHOL PROGRAM FOR SAFETY SENSI
TIVE FUNCTIONS
Recitals:
1. The City Council desires to adopt a drug and alcohol program covering employees performing
safety sensitive functions.
2. The City Council finds that good judgment, fitness, dexterity, and integrity are essential to the
effective performance of duties requiring possession of firearms and/or the enforcement of
laws regarding illegal drug and alcohol use,possession,and trafficking thereof.
3.Personnel carrying firearms or enforcing laws against illegal drug and alcohol use,possession
or trafficking while under the influence of alcohol and/or drugs pose a threat to the safety of
the public and co-workers and impairs the City of Moses Lake's ability to enforce laws prohib
iting illegal drug and alcohol use,possession and trafficking thereof.
4. The City of Moses Lake has a compelling governmental interest in protecting the public and
co-workers from the dangers posed by employees under the influence of alcohol or drugs who
carry firearms as part of the duties and maintaining their integrity necessary for effective en
forcement of laws relating to illegal drug use,possession or trafficking thereof.
5.Employees performing safety sensitive functions currently have a reduced expectation of
privacy and undergo background investigations and fitness for duty testing. Direct supervision
is not always possible and random drug and alcohol testing of those employees performing
safety sensitive functions is a reasonable means of achieving the City of Moses Lake's com
pelling governmental interests.
6.The City Manager recommends that the following positions be designated safety sensitive and
the City of Moses Lake adopt the drug and alcohol program covering such functions and such
program is consistent with the City of Moses Lake's commitment to a drug free workplace:
Police Chief
Assistant Police Chief
Police Sergeant
Police Corporal
Police Officer
Police Utility Officer
Resolved:
1.Duties that involve the possession of a firearm and/or the enforcement of laws prohibiting the
illegal use,possession and/or trafficking of alcohol and/or drugs are safety sensitive functions.
Those positions are identified in Recital 6.
2. Good judgment,fitness,dexterity,and integrity among other attributes are essential require
ments to the effective performance of these safety sensitive functions.
3.Employees performing safety sensitive functions while under the influence of illegal drugs
and/or alcohol pose a threat to the safety of the public and co-workers and impairs the City of
Moses Lake's ability to enforce laws relating to illegal drug and alcohol use,possession and/or
trafficking of the same.
4. The City of Moses Lake has a compelling interest in protecting the public from the danger
posed by employees under the influence of alcohol and/or drugs who carry firearms as part of
their duties and maintaining the integrity necessary foreffectiveenforcement of laws prohibiting
illegal drug and/or alcohol use,possession and/or trafficking thereof.
5.Individuals currently performing safety sensitive functions have a reduced expectation of
privacy and the drug and alcohol testing program is a reasonable means ofachieving the City
of Moses Lake's compelling governmental interests.
6. The Drug and Alcohol Testing Program covering employees performing safety sensitivefunc
tions is hereby approved.
