1946o <J ^ RESOLUTION NO.1946 A RESOLUTION ACCEPTING AN EASEMENT TO THE CITY OF MOSES LAKE FROM ERNIE REINHARDT Recitals: 1.Resolution No.238 provides that all grants of real estate,or any interest therein,to the City of Moses Lake,shall not be accepted until a resolution has been duly passed by the City Council. 2.Ernie Reinhard has presented an easement to the City of Moses Lake. Resolved: 1.An easement for utility purposes for the following described property is hereby accepted by the City of Moses Lake: A utility easement in the Southeast 1/4 of Section 25,Township 19 North,Range 28 East,W.M;Grant County,Washington described as follows: Commencing at the south quarter corner of Section 25,Township 19 North,Range 28 East,W.M;thence North 00°38,12"East,868.50 feet to the northwest corner of Ernie*s Second Addition Plat,recorded in Volume 16 of Plats,Page 42 and 43, under Auditor's File Number 950303079;thence South 89°19'20"East,228.50 feet along the north line of said plat,to the point of beginning;thence South 00°38,12"West,684.50 feet;thence North 89°19'20"West,20.00 feet to the west line of Ernie's Second Addition Plat;thence South 00°38,12"West,5.00 feet along said west line;thence South 89°19,20"East,20.00 feet;thence South 00°38,12"West,73.00 feet;thence North 89°19,20n West,20.00 feet to the west line of Ernie's Second Addition Plat;thence South 00°38'12"West,5.00 feet along said west line;thence South 89°19'20"East,20.00 feet;thence South 00°38'12"West,71.00 feet to the south line of Ernie's Second Addition Plat, which is also the north right of way line of Kittleson Road;thence South 89°19'20"East,20.00 feet along said south line;thence North 00°38'12"East, 838.50 feet to the north line of Ernie's Second Addition Plat;thence North 89°19'20"West,20.00 feet along said north line to the point of beginning. The foregoing easement is granted with the following provisions: 1.The Grantor,his heirs,successors,and assigns shall not be prohibited from installing supplemental utility services or crossings through or within the subject easement area. 2.The Grantor and/or the City of Moses Lake,their heirs,successors,and/or assigns shall retain the right to relocate the waterline and related utility easement facilities to an alternative functional corridor in the event any such relocation is deemed necessary to accomplish any future land use objectives which might later evolve. 3.Any such relocations and site restorations will be accomplished at the proponents sole expense. 4.Utility services within the easement corridor will be constructed to applicable City of Moses Lake design standards.
