RESOLUTION NO.1949
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOSES LAKE
DECLARING ITS INTENTION TO IMPROVE A PORTION OF NELSON ROAD
EAST OF HIGHWAY 17 BY CONSTRUCTING AND INSTALLING A SANITARY
SEWER SYSTEM AND CONNECTING THE SANITARY SEWER SYSTEM TO
THE EXISTING SANITARY SEWER,INSTALLING A WATER SYSTEM AND
CONNECTING THE WATER SYSTEM TO THE EXISTING WATER SYSTEM
AND BY IMPROVING NELSON ROAD WITH PAVEMENT CURBS,GUTTERS,
SIDEWALKS,AND STORM DRAINAGE AND TO CREATE A LOCAL IM
PROVEMENT DISTRICT TO ASSESS THE COST AND EXPENSE OF SAID
IMPROVEMENTS AGAINST PROPERTY IN SUCH DISTRICT SPECIALLY
BENEFITTED THEREBY,AND TO NOTIFY ALL PERSONS WHO MAY
OBJECT TO SAID IMPROVEMENT TO APPEAR AND PRESENT THEIR
OBJECTIONS AT A REGULAR MEETING OF THE CITY COUNCIL TO BE
HELD ON APRIL 9,1996 AT 7 P.M.
1. The property owners, representing at least 50% of the amount of the assessed valuation and
representing more than 50% of the lineal front footage of the properties specially benefitted by a
proposed local improvement district (LID)have presented petitionsto the Moses Lake CityCouncil
asking that the City Council initiate an LID.The original of each petition shall be filed with this
resolution inthe permanent legislativehistoryfilesinthe Cityof Moses Lake. The Moses Lake City
Council has accepted those petitions froma majorityof the propertyowners with propertywithinthe
proposed Local Improvement District.
2. A map outlining the proposed potential boundaries of the local improvement district which will bear
the cost of the improvements,shall be filed with this resolution inthe permanent legislative history
files of the City of Moses Lake.
RESOLVED:
1. That it is the intent of the City Council of the City of Moses Lake to order the improvement of a
portionof Nelson Road by constructing and installing a sanitary sewer system along Nelson Road
~and connecting the sewer system to the existing sanitary sewer located in Nelson Road,construct-
i^J ing and installing awater system along Nelson Road and connecting the water to the existing water
system located in Nelson Road and by improving Nelson Road with pavement,curbs, gutters,
sidewalks,and storm drainage. All of the foregoing shall be in accordance with the plans and
specifications prepared under the direction of the City of Moses Lake. All of the foregoing will be
one continuous unit of the proposed improvement
2.That the improvement shall consist of extending a sewer main down Nelson Road from the end of
the existing sewer main in Nelson Road as it fronts on Lakeland Addition Division#1,extending a
water main down Nelson Road from the end of the existing water main in Nelson Road as it fronts
on Tax #7758 in Farm Unit 117, Block 41, in NENW 25-19-28,and by improving Nelson Road from
the intersection of Highway 17, all to the easterly boundary of Tax #7758 in Farm Unit 117, Block
41 in NENW 25-19-28 and Tax #10507 in Lot 17,College Heights.The properties specially
benefitted shall include those legally described as:

3. That the actual assessments may vary from the assessment estimates so longas the assessments
do not exceed a figure equal to the increased true and fair value the improvement adds to the
property.
4. That the assessments shall be for the sole purpose of payment into such revenue bond fund as
may be specified by the City Council for the payment of revenue bonds issued to defray the cost
of the improvement.
5. That the entire cost and expense of said improvement shall be borne and assessed against the
property specially benefitted by such improvement to be included in the local improvement district
to be established embracing as near as may be all property specially benefitted by such improve
ment.
6. That all persons who may desire to objectto the improvement hereinmentioned are hereby notified
to appear and present such objections at a meeting of the City Council inthe Police/Court Building,
Moses Lake, Washington at 7 p.m. on April 9,1996,which time and place are hereby fixed for
hearing all matters relating to said proposed improvement,and all objections thereto, and for
determining the method of payment of said improvement.
7. The Municipal Services Director of the City of Moses Lake is hereby directed to submit to the City
Council on or prior to April 9,1996 all data and information required by law to be submitted.
