RESOLUTION NO.1064
A RESOLUTION INITIATING THE PROCEDURE FOR VACATING THE SIXTY
FOOT PUBLIC RIGHT-OF-WAY AS DEDICATED IN DEED RECORD NO. 12
AS RECORDED IN FILE NO.13812 BY THE GRANT COUNTY AUDITOR AND
THE EIGHTY FOOT PUBLIC RIGHT-OF-WAY AS DEDICATED ON THE PLAT
OF NEPPEL
WHEREAS,the Moses Lake School District has requested that the sixty foot public
right-of-way as dedicated in Deed Record No. 12 as recorded in File No.13812 by
the Grant County Auditor and the eighty foot public right-of-way as dedicated on
the Plat of Neppel be vacated,and
WHEREAS,RCW 35.79 provides that a public street may be vacated upon a resolution
initiated and passed by the legislative authority of the jurisdiction where the
street is situated,
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Moses Lake,
Washington,that the petition for the vacation of the following described public
right-of-way shall be accepted:
Parcel A - A portion of a right-of-way sixty feet wide in the NW%of Section 23,
Township 19 North,Range 28 EWM,Grant County,Washington,with a centerline des
cribed as follows:
Commencing at the intersection of the Birch Street and Sixth Street as
recorded in 1912 in Grant County and thence north BS^O^"east 40.00
feet to the True Point of Beginning;thence north 53°40,54"east 300.00
feet to the southwesterly boundary of Chestnut Street.This parcel is
18,000 square feet.
Parcel B - A portion of the eighty foot wide street right-of-way in the north
quarter of Section 23,Township 19 North,Range 28 EWM,Grant County,Washington,
with a centerline described as follows:
Commencing at the intersection of Sixth Street and Birch Street (Balsam
St.)as dedicated on the Plat of Neppel;thence south 36°19,06"east
30.00 feet to the True Point of Beginning;thence north 36°19'06"west
360.00 feet to the southeasterly boundary of Fifth Avenue.This parcel
contains 28,800 square feet.
BE IT FURTHER RESOLVED that the first reading of the ordinance on the vacation of
the right-of-way be set for April 14,1981 with the second reading of the ordinance
and the public hearing being set for April 28,1981.
PASSED by the City Council of the City of Moses Lake,Washington,and APPROVED by
its Mayor this 24th day of March,1981.
