1098•v RESOLUTION NO.1098 A RESOLUTION REGARDING THE MOSES LAKE SPRING FESTIVAL TO BE HELD MAY 28 THROUGH MAY 30,1982 WHEREAS,the Moses Lake Spring Festival has organized a Spring Festival for the City of Moses Lake to occur on May 28,29,and 30,1982 and WHEREAS,the Moses Lake Spring Festival had previously,in 1980,requested endorse ment of the City of Moses Lake for the Festival,and WHEREAS,the City of Moses Lake,in 1980,previously passed a resolution endorsing such a Moses Lake Spring Festival,and WHEREAS,the Moses Lake Spring Festival has requested the assistance of the City of Moses Lake in order to make the Festival a success,and WHEREAS,the City of Moses Lake intends to do whatever it can to make the Festival successful, NOW,THEREFORE,BE IT RESOLVED that the Moses Lake Spring Festival shall be allowed to use city property for Festival related activities,i.e.a carnival and Indian village in McCosh Park,a 4-wheel drive mud race obstacle course on undeveloped land at Cascade Valley Park,and drag boat races at Cascade Valley Park. BE IT FURTHER RESOLVED that if staff is available and the swimming pool is open, there shall be no charge for swimming in the McCosh Park swimming pool on May 28, 29,and 30,1982. BE IT FURTHER RESOLVED that the City Council of the City of Moses Lake approves of street barricading for the parade and other Festival activities as is required by the Moses Lake Spring Festival as set forth in their letter to the Honorable Mayor and City Councilmembers dated February 2,1982. BE IT FURTHER RESOLVED that the city shall absorb the in-kind financial expenses for street sweeping,garbage pick-up,and solid waste dumping fees,such garbage pick-up and dumping fees not to exceed $800.The garbage pick-up,solid waste dumping fees,and the expense for street sweeping as absored by the city is consid ered an additional expense of providing city services during the period the Festi val takes place. BE IT FURTHER RESOLVED that the Police Department will provide minimum police services with the Moses Lake Spring Festival providing special security personnel which must be approved by the Police Chief prior to Festival time. BE IT FURTHER RESOLVED that the City Council of the City of Moses Lake recommends that water hook-ups be made to existing businesses by using hose bibs with the property owner where the water is hooked-up paying for any water usage.If there are any special requests to supply water,it will be the decision of the Public Works Director as to the charges to be assessed. BE IT FURTHER RESOLVED that the Moses Lake Spring Festival is allowed to use the city's building at Third and Alder in the City of Moses Lake upon the terms and conditions set forth in the Use Agreement prepared by the City of Moses Lake. BE IT FURTHER RESOLVED that the Moses Lake Spring Festival shall provide liability insurance in amounts and with the type of coverage requested by the City Manager with the City of Moses Lake being named as an additional co-insured. BE IT FURTHER RESOLVED that the Moses Lake Spring Festival shall execute an indem nity/hold harmless agreement whereby the Moses Lake Spring Festival shall hold the City of Moses Lake harmless from any claims for damage and indemnify the City of Moses Lake from any liability which may arise as a result of the Moses Lake Spring Festival using any city property,public streets,or public sidewalks for any Festival related activity. RES.1098;Page 2 BE IT FURTHER RESOLVED that the City of Moses Lake shall pay up to $1,662 in adver tising expenses,such funds being spent to promote tourism in the Moses Lake area according to the authority conferred by law.The figure spent,up to $1,662,is to come from the Convention and Stadium Reserve Fund.The figure spent,up to $1,662, shall be paid directly by the City of Moses Lake upon being presented bills for the advertising expenses incurred.
