A RESOLUTION INITIATING THE PROCEDURE FOR VACATING A FIFTY
FOOT RIGHT-OF-WAY DEDICATED AS MAIN STREET ADJACENT TO
BLOCK NO.l,CAPISTRANO PARK PLAT AS DEDICATED ON THE CAP-
ISTRANO PARK PLAT
WHEREAS,the owners of more than two-thirds of the property abutting upon the
fifty foot public right-of-way dedicated as Main Street adjacent to Block No.1,
Capistrano Park Plat as dedicated on the Capistrano Park Plat as recorded in
Volume 3 of Plats,Page 29,Records of Grant County,Washington have requested
that the street be vacated,and
WHEREAS,RCW 35.79 provides that a public street may be vacated upon resolution
initiated and passed by the legislative authority of the jurisdiction where the
street is situated and that such resolution shall fix a time when the petition
will be heard and determined which shall not be more than sixty days nor less
than twenty days after the passage of such resolution,
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Moses Lake,
Washington,that the petition for the vacation of the following described public
right-of-way shall be accepted:
A portion of a road right-of-way fifty feet wide in the South East h of the
North East h of Section 28,Township 19 North,Range 28 West,Willamette
Meridian,Grant County,Washington more fully described as follows:
Beginning at the south east corner of Lot 4,Block 1 of
Capistrano Park,said Section 28;thence N 45°32'40"W a
distance of 50.00 feet;thence N 44027'20"E a distance
of 120.00 feet;thence S 45032'40"E a distance of 50.00
feet;thence S 44o27'20"W a distance of 120.00 feet to
the point of beginning.Said tract of land contains
6,000.00 square feet of land.
BE IT FURTHER RESOLVED that a first reading of a vacation ordinance shall be set
for May 8,1984;that a Public Hearing before the Planning Commission shall be
set for May 10,1984;and,that a second reading of a vacation ordinance shall
be set for May 22,1984.
PASSED by the City Council of the City of Moses Lake,Washington,and APPROVED by
its Mayor this 10th day of April,1984.
