RESOLUTION NO.1185
A RESOLUTION INITIATING THE PROCEDURE FOR VACATING A
DEDICATED CITY STREET KNOWN AS MONTLAKE PLACE ADJACENT
TO LOTS 10 - 13 OF THE HYLAND PARK ADDITION NO. 1 PLAT
1. The owners of more than two thirds of the property abutting upon the sixty
foot right-of-way dedicated as Montiake Place adjacent to Lots 10 - 13 of
Hyland Park Addition No. 1 Plat as recorded in Volume 7 of Plats,Page 70,
Records of Grant County have requested that the street be vacated.
2.RCW 35.79 provides that a public street may be vacated upon resolution initi
ated and passed by the legislative authority of the jurisdiction where the
street is situated and that such resolution shall fix a time when the petition
will be heard and determined which shall not be more than sixty days nor less
than twenty days after the passage of such resolution.
IT IS RESOLVED by the City Council of the City of Moses Lake,Washington,that the
petition for the vacation of the following described public right-of-way shall be
accepted:
The city street right-of-way known as Montlake Place is located in the NW%of
Section 26,Township 19 North,Range 28 East,W.M.,County of Grant,State of
Washington,and is more fully described as follows:
Commencing at the southwest corner of the NW%of said section;thence North
00°10'30"east on the westerly boundary line of the NW%of said section a
distance of 413.75 feet;thence North 10°48'30"east on the centerline of
Division Street,formerly designated as Montlake Drive and also formerly known
as Potato Hill Road,a distance of 1,271.40 feet;thence North 69°11'13"west
a distance of 30.00 feet to the southerly most corner of the plat known as
Hyland Park Addition No.1,as recorded in Volume 7 of plats,page 70,Record
of Grant County,Washington;thence North 20°48'30"east on the southeasterly
boundary line of said plat and the northwest right-of-way boundary line for
the city street known as Division Street a distance of 80.00 feet to the
easterly corner of Lot 13 of said plat and to the True Point of Beginning;
thence continuing North 20°48'30"east on the southeasterly boundary line of
said plat and the northwesterly right-of-way boundary line of said city street
a distance of 60.00 feet to the southerly corner of Lot 10 of said plat;
thence North 69°H'30"west on the southwesterly boundary line of said Lot 10
a distance of 113.54 feet;thence southwesterly on a 40 foot radius curve
concave to the southeast along the southwesterly boundary line of Lot 10 of
said plat,the southerly boundary line of Lot 11 of said plat,the east bound
ary line of Lot 12 of said plat and the northwest boundary line of Lot 13 of
said plat an arc distance of 183.48 feet,the long chord of said curve being
South 20o48'30"west a distance of 60.00 feet;thence South 69oll'30"east on
the northeasterly boundary line of Lot 13 of said plat a distance of 113.54
feet to the True Point of Beginning.
IT IS FURTHER RESOLVED that a first reading of a vacation ordinance shall be set
for June 12,1984;that a public hearing before the Planning Commission shall be
set for June 14,1984;and that a second reading of a vacation ordinance shall be
set for June 26,1984.
Adopted by the City Council and signed by its Mayor on May 8,1984.
