A RESOLUTION ACCEPTING A QUIT CLAIM DEED TO THE
CITY OF MOSES LAKE FOR REAL PROPERTY
RECITALS:
1.Resolution #238 provides that all grants of real estate,or any
interest therein,to the City.of Moses Lake,shall not be accepted
until a resolution has been duly passed by the City Council.
2.The State of Washington has presented a deed to the City of Moses
Lake for real property to be used as right of way on Clover Drive
at the intersections of Nelson Road and Pioneer Way.
IT IS RESOLVED:
1.The deed for the following described property is hereby accepted by
the City of Moses Lake:
Those portions of the southwest quarter of the northwest quarter of
Section 25,and the southeast quarter of the northeast quarter of
Section 26,Township 19 North,Range 28 East,W.M.,lying within
the Clover Drive right of way and Pioneer Way right of way;
also the southeast quarter of the southeast quarter of Section 23,
said Township and Range lying within the Clover Drive right of
way all as shown hachured on Exhibit "A"being sheets 1 and 2 of
that certain plan entitled SR 17,Jet.P.S.H.18 to Ephrata Wye.
The grantee herein,its successors or assigns,shall have no right
of ingress and egress to,from and between said SR 17 and the lands
herein conveyed and will maintain the control of ingress and egress
to,from and between the lands herein conveyed and the lands adjacent
thereto,as indicated by the prohibition of access symbol appearing
on said Exhibit "A";nor shall the grantee herein,its successors
or assigns,be entitled to compensation for any loss of light,view
and air occasioned by the location,construction,maintenance or
operation of said highway;EXCEPT that said grantee,its successors
or assigns,shall have reasonable ingress and egress to,from and
between the lands herein conveyed and said highway by means of
the off and on ramps thereto shown on said Exhibit "A".
It is understood and agreed that the above referenced property is
transferred for street purposes and that all revenue resulting from
vacation,sale,or rental for such streets shall be placed in the
Moses Lake street fund and used exclusively for street purposes.
