1252RESOLUTION NO.1252 A RESOLUTION AUTHORIZING THE CITY MANAGER TO GRANT AN EASEMENT TO JOYCE MARIE MELING AND GORDON LEE MELING RECITALS: 1.Mr.R.W.Crosthwaite of Peoples Properties,Inc.,Moses Lake, representing property located at 709 Penn Street,Moses Lake,Washington, owned by Joyce Marie Meling and Gordon Lee Meling,has requested an easement.Mr.Crosthwaite has submitted a letter to the City,dated January 6,1986,requesting the easement. 2.Easement is for an existing building located at 706 Penn Street to encroach upon City right-of-way. RESOLVED: 1.The City Manager and City Clerk be authorized to execute an easement for the following described property: Commencing at the south quarter corner of Section 14,thence along the south line of the SE 1/4 of said Section 14,north 89°40'00"east,a distance of 110 feet;thence north 0°12'00"west,a distance of 420 feet; thence north 89o48'00n east a distance of 40 feet to the true point of beginning;thence north 0o12,00"west a distance of 140 feet;thence south 89°48'00"west a distance of 0.5 feet;thence south O^'OO"east a distance of 140 feet;thence north Sg^'OO"east 0.50 feet to the true point of beginning.Total area 70 square feet. This easement shall be subject to the following conditions: 1.This easement is given for the express purpose of allowing an existing building to encroach upon City of Moses Lake property and none other. 2.This easement reverts to the Grantor,City of Moses Lake if the portion of the existing building lying within the easement is removed from within the easement,and/or the easement is used for any other purpose. 3.The Grantee is not permitted any new construction within this easement.
