RECITALS:
RESOLUTION NO. 1321
A RESOLUTION INITIATING THE PROCEDURE FOR VACATING A PORTION
OF MARINA DRIVE ADJACENT TO TAX #1323
1.The owners of more than two-thirds of the property abutting upon Marina
Drive adjacent to Tax #1323 have requested that a portion of the street
be vacated.
2.RCW 35.79 provides that a public street or any part thereof may be va
cated upon resolution initiated and passed by the legislative authority
of the jurisdiction where the street is situated and that such resolution
shall fix a time when the petition will be heard and determined and which
shall not be more than sixty days nor less than twenty days after the
passage of such resolution.
RESOLVED:
1.The petition for the vacation of the following described public right-of-
way shall be accepted:
A portion of a right of way 10'x 181.5'in Section 28,Township 19
North,Range 28 EWM,Grant County,Washington,described as follows:
Beginning at the southwest corner of the NE 1/4 NE 1/4 Section 28;thence
north 0°23'55"east along the west line of said subdivision 443.00 feet;
thence 151.90 feet south 89°55'50"east to the westerly right-of-way line
of a road known as Marina Drive and the true point of beginning;thence
north 22O57'30"east a distance of 181.50 feet;thence south 89O55'50"
east a distance of 10.85 feet;thence south 22°57'30"west a distance of
181.50 feet;thence north 89°55'50"west a distance of 10.85 feet to the
true point of beginning.
2.The vacation ordinance shall stipulate that the city shall be compensated
in the amount of one half the appraised value of the area to be vacated
and that the city shall retain an easement for public utility purposes on
the entirety of the area to be vacated.
3.The public hearing before the Planning Commission shall be set for June
11,1987,the first reading of a vacation ordinance shall be set for June
23,1987,and that a second reading of a vacation ordinance shall be set
for July 14,1987.
