A RESOLUTION DIRECTING RECONSTRUCTION OF SIDEWALK ABUTTING
PROPERTY COMMONLY DESCRIBED AS 1103 AND 1107 BAKER STREET
RECITALS:
1.The City of Moses Lake is going tooverlay Baker Street during the summer
of 1988.
2.During the city's review of the Baker Street overlay project,the city
determined that some sidewalk abutting property commonly described as
1103 and 1107 Baker Street is substandard and is unfit and unsafe for
public travel.The sidewalk in question,which is substandard and unfit
and unsafe for public travel,is less than one block in length on Baker
and is less than one block in length on Eleventh and the sidewalk on the
street adjacent to both ends of sidewalk sought to be reconstructed is
improved and in good repair.
3.A map visually illustrating the sidewalk which is determined to be sub
standard and unfit and unsafe for public travel abutting 1103 and 1107
Baker Street is attached to this resolution and incorporated by reference
herein.
4.The city has requested the owner(s)of 1103 and 1107 Baker Street to
voluntarily repair the sidewalk,but the owners have refused.A copy of
the city's letter to the then owners of the property dated January 21,
1988 is attached to this resolution and incorporated by reference herein.
5.The city has the authority to require property owners to reconstruct
sidewalk which is in disrepair and is substandard and unfit and unsafe
for public travel pursuant to RCW 35A.11.020,RCW 35.68,and RCW 35.69.
RESOLVED:
1.The property owner(s)of 1103 and 1107 Baker Street is (are)ordered to
reconstruct the sidewalk which is substandard and is unfit and unsafe for
public travel at his/her/their expense.The property owner(s)shall com
mence and complete the reconstruction of the substandard sidewalk which
is unfit and unsafe for public travel before the city begins the overlay
of Baker Street during the summer of 1988,the exact dates of which can
be obtained from the Municipal Services Director.If the substandard
sidewalk,which is unfit and unsafe for public travel,is not recon
structed by the time the city begins the overlay of Baker Street,the
city shall reconstruct the sidewalk in question and assess the cost
against the abutting property owner(s).
2.A hearing on this resolution shall be held during the regular City Coun
cil meeting on June 14,1988 which begins at 8 p.m.in the Council Cham
bers in the Police/Court Building in the City of Moses Lake.
3.This resolution shall be published in the official newspaper of the city
on two consecutive weeks prior to the public hearing on the resolution
and a notice of the date of the hearing shall be served according to law
upon the abutting owner(s)or reputed owner(s)of the property as shown
on the tax rolls of the County Treasurer at least 10 days before June 14,
1988.
4. The reconstruction of the substandard and unfit and unsafe sidewalk abut
ting 1103 and 1107 Baker Street is necessary for the public safety and
convenience.
