A RESOLUTION ESTABLISHING A CODE OF CONDUCT FOR THE CITY
TO COMPLY WITH THE REQUIREMENTS OF THE DEPARTMENT OF
COMMUNITY DEVELOPMENT AND THE FEDERAL GOVERNMENT IN
CONNECTION WITH THE CITY OF MOSES LAKE 1988 DEPARTMENT
OF COMMUNITY DEVELOPMENT SMALL CITIES DISCRETIONARY
COMMUNITY DEVELOPMENT BLOCK GRANT.
Recitals;
1.The City is a successful application for the Federal
Department of Housing and Urban Development (HUD)funds
as administered by the Washington Department of Community
Development (DCD)to be used for the purpose of a Small
Cities Discretionary Community Development Block Grant
(CDBG).
2. As a grantee of such CDBG funds,the City is required to
adopt a code of conduct as specified in funds in
compliance with Federal Office of Management and Budget
(OMB)Circular A-102,Attachment O,Paragraph 7.
3. This resolution is adopted to insure the efficient, fair
and professional administration of these CDBG funds in
compliance with Federal Office of Management and Budget
(OMB)Circular A-102,Attachment O,Paragraph 7,and
other applicable federal and state standards,regulations
and laws.
Resolved;
1.This code of conduct applies to all officials,officers,
employees, agents or consultants of the City engaged in
the award or administration of contracts supported by
federal grant funds.
2.No official,officer,employee,agent or consultant of
the City shall participate in the selection,award or
administration of a contract supported by federal grant
funds,if a conflict of interest,real or apparent,would
be involved.Such a conflict would arise when:
2.1 The official,officer,employee,agent or
consultant;
2.2 Any member of his/her immediate family;
2.3 His/her partner;or
2.4 An organization which employs,or is about the
employ any of the above has a financial or other
interest in the firm selected for the award.
For purposes of this recital,a prohibited interest in
the award or administration of a contract is an interest
in excess of $500 as to the entire project.
3.City officials,officers,employees,agents or consultant
shall neither solicit nor accept gratuities,favors,or
anything of monetary value from contractors, potential
contractors or subcontractors.This prohibition shall not
apply to unsolicited items of intrinsic value only.
4. To the extent permitted by federal,state or local laws
or regulations,violation of these standards may cause
penalties,sanctions,or other disciplinary actions to
be taken against the City's officials, officers,
employees,agents or consultants,or the contractors,
potential contractors, subcontractors, or their agents.
Such sanctions may include referral to the proper
authority for criminal prosecution pursuant to RCW Title
9A.
