1441RECITALS: RESOLUTION NO. 1441 A RESOLUTION DESCRIBING PROPERTY OMITTED FROM THE PRELIMI NARY ASSESSMENT ROLL FOR ULID NO.3 ESTABLISHED BY CITY OF MOSES LAKE ORDINANCE NO.1339,GIVING NOTICE TO ALL PER SONS WHO OBJECT TO THE OMITTED PROPERTY BEING INCLUDED IN ULID NO.3 TO APPEAR AND PRESENT THEIR OBJECTIONS AT A PUBLIC HEARING SCHEDULED DURING A REGULAR MEETING OF THE CITY COUNCIL TO BE HELD ON MARCH 14,1989 AT 8 P.M.,AND DIRECTING THE ENGINEERING DIVISION OF THE MUNICIPAL SER VICES DEPARTMENT OF THE CITY OF MOSES LAKE TO REPORT TO THE COUNCIL AT OR PRIOR TO THE DATE FIXED FOR THE HEARING ON THE AMOUNT WHICH SHOULD BE BORNE BY EACH LOT,TRACT,OR PARCEL OF LAND SO OMITTED 1.Based upon the petitions the City of Moses Lake received from interested property owners,the city formed ULID 3 with Ordinance No.1339.Or dinance No.1339 is contained in the city's legislative history file. 2.The City Council of the City of Moses Lake passed Ordinance No.1339 after holding a public hearing the date of which was established by City of Moses Lake Resolution No.1404.Resolution No.1404 is contained in the city's legislative history file. 3.There were no objections expressed at the properly scheduled and held public hearing to the formation of ULID 3 from any interested or affected property owners. 4.Property legally described as Tax #10346 including portions of Lot 19 and Parcel No.4,Lakeshore Estates in Section 32,Township 19 North,Range 28 EWM owned by Paul R.and Catherine Kersey as shown by the official records of Grant County,was by mistake or inadvertence omitted from the preliminary assessment roll for ULID No.3 and except for the omission would have been subject to assessment. RESOLVED: 1.Upon its own motion and with this resolution it is declared to be the intent of the City Council of the City of Moses Lake to include in ULID No.3 Tax #10346 including portions of Lot 19 and Parcel No.4,Lakeshore Estates in Section 32,Township 19 North,Range 28 EWM.The improvement shall be in accordance with the plans and specifications therefore pre pared under the direction of the City of Moses Lake. 2.The omitted property as legally described herein shall be assessed in accordance with the benefits accruing to it by reason of the improvement in proportion to the assessments levied upon other property in ULID No. 3. 3.All persons who may desire to object to the omitted property being in cluded in ULID No.3 are hereby notified to appear and present such ob jections at a public hearing scheduled during a regular meeting of the Moses Lake City Council held in the Police/Court Facility,Moses Lake, Washington at 8 p.m.on March 14,1989. 4.The Engineering Division of the Municipal Services Department of the City of Moses Lake is hereby directed to submit to the City Council on or prior to March 14,1989 the amount which should be borne by the omitted lot,tract,or parcel of land so omitted and any and all other data and information required by law to be submitted.
