736• RESOLUTION NO.736 RESOLUTION TO PERMIT DARRELL E.RIES AND JOHN E.JONES TO BUILD ON UNPLATTED PROPERTY IN ACCORDANCE WITH CHAPTER 3.4,SECTION 3.4.08 OF THE MOSES LAKE CITY CODE. WHEREAS,Darrell E.Ries and John E.Jones are the holders of a long term ground lease of the hereinafter described property,the owners of which are the Trustees of the Estate of Martin Penhallick,and WHEREAS,the said Darrell E.Ries and John E.Jones desire to construct buildings and improvements upon the hereinafter described property to be leased to Pizza Hut of Spokane,Inc.,for the purpose of operating thereon an establishment for the sale of food and drinks to the public,and WHEREAS,said property is presently unplatted and although a Plat has been pre pared to plat said property,and all other properties in interest are willing to execute said Plat,Seattle-First National Bank and the other Trustees of the Estate of Martin Penhallick have refused to execute said Plat except on conditions which are not acceptable to the Lessees,and WHEREAS,all of the streets,sidewalks and utilities are in existence and no further streets,sidewalks or utilities are required for full use of the property, NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Moses Lake that the City building inspector is hereby authorized to issue a building permit for buildings and improvements to be constructed upon the following described real property in the City of Moses Lake,County of Grant,State of Washington,to-wit: That portion of the Southwest of the Southwest quarter of Section 14, Township 19 North,Range 28 E.W.M.,Grant County,Washington, desc ribed as follows: Beginning at the point of intersection of the Southeasterly boundary line of Broadway and the Northeasterly boundary line of Chestnut Street,as shown on the Plat of Neppel as per plat filed October 15, 1912,records of Grant County,Washington;thence North 53 42' East along the Southeasterly line of said Broadway extended,a distance of 150 feet;thence South 36 18'East 140 feet;thence South 53 42»West 44.94 feet,more or less,to the Northerly boundary line of Primary State Highway No.18,as conveyed to the State of Washington by deed dated December 9,1937,filed February 5,1938,File No.73770;thence Westerly along said Northerly line,to the Northeasterly line of Chestnut Street;thence North 36 18*West 73.53 feet,more or less,to the point of beginning. Provided that developers and builders comply with all other applicable ordinances of the City of Moses Lake and the requirement that the property be platted before a building permit be issued is hereby waived.
