RESOLUTION NO.797
A RESOLUTION OP THE CITY COUNCIL OF THE CITY OF
MOSES LAKE,WASHINGTON DECLARING ITS INTENTION TO
ESTABLISH A BUSINESS IMPROVEMENT AREA AS PROVIDED
BY STATE LAW AND FIXING A TIME,DATE AND PLACE FOR
THE HEARING OF THIS RESOLUTION OF INTENT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON AS FOLLOWS:
Section 1. That it is the intention of the City Council of the City of Moses Lake as
provided by initiative petition presented to the Council within the area as follows:
Beginning at the intersection of Broadway and Alder,thence Southeasterly
along the centerline of Alder to the intersection of the centerline of
Fifth Avenue, thence Southwesterly along the centerline of Fifth Avenue
to the centerline of Beech, thence Northwesterly along the centerline of
Beech to the centerline of Broadway, thence Northeasterly along the
centerline of Broadway to the centerline of Alder Street.
and made a part hereof and to levy special assessments against all types of businesses,
including professions,within said area to pay for the aforesaid proposed uses and
projects,and special assessments to be in accordance with the following rates on pro-
,(posed businesses within the area.

The number of personnel employed as of September 1 of each year will be used to determine
the assessment for the following year.Assessment rates will be adjusted on an annual
basis by the City Clerk.
Section 2. The total estimated cost .for the acquisition and construction of the off-
street parking facilities is $271,000.00.It is the City's intention to levy a special
assessment against all businesses as provided in Section 1 hereof over an estimated
20-year period on an annual basis for the purpose of paying the total cost of the off-
street parking facilities, including any interests on bonds or improvement notes which
may be issued by the City for such purposes.
Section 3. The revenues from such special assessments shall be solely for the purpose
of retiring in whole or in part bonds or improvement notes to be issued by said City for
the promotion of retail trade activity within the proposed business improvement area.
Section 4. New businesses which enter the business'improvement district will, after
being in the district for one year, be assessed.
!Section 5.The City will accept ownership of real property and will maintain the
facility.
i Section 6. Businesses which do not pay their assessment will be taken to the Small
Claims Court by the City.
Section 7. All persons who may desire to object to the formation of such a business
improvement area are hereby notified to appear and present such objection at a meeting
of the City Council to be held in the City Hall Council Chambers,City Hall,Moses Lake,
Washington,on February 15,1977;which time and place are hereby fixed for hearing of
matters relating to said improvements and all objections thereto,and for determining
the final boundary of the area and method of payment for said improvements.
\The City Clerk is hereby directed to prepare and give notice of such hearing in the
manner prescribed by law,
