919LJ RESOLUTION NO.919 A RESOLUTION AMENDING RESOLUTION NO.704 BY DEFINING SICK LEAVE BENEFITS FOR MEMBERS OF THE LAW ENFORCEMENT OFFICERS AND FIRE FIGHTERS RETIREMENT SYSTEM WHEREAS,there is a need to define those sick leave benefits to be given to members of the Law Enforcement Officers and Fire Fighters Retirement system,and WHEREAS,it is the intent of this resolution to establish procedures for the use of sick leave benefits by LEOFF members which will result in a more efficient govern mental operation: NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON AS FOLLOWS: Section 17.Sick Leave Benefits shall be amended to read as follows: Employees of the City of Moses Lake,except members of the Law Enforcement and Fire Fighter Pension as prescribed under RCW 41.26,shall accrue sick leave at the rate of eight (8)hours of leave for each full calendar month of employees'service. Sick leave may be accumulated to a maximum of nine hundred and sixty (960)working hours.25%of an employees accumulated sick leave will be paid as severance pay upon voluntary termination after ten (10)years of service. FOR MEMBERS OF LEOFF -1 Each fire member working the Detroit 56 schedule will be granted four (4)(24 hour) non-accruing shifts (96 hours)of sick leave per year.Each police member and fire member working standard hours (8 hour shifts)will be granted seven (7)non-accruing days (56 hours)of sick leave per year.These days will not carry over and accumu late to the following year. Each day of sick leave taken under these provisions will be submitted on the city "leave request"form through the department head to the City Manager for approval the day the employee returns to work.If,during the course of a year,all seven days or four shifts are used,additional sick leave will be applied for and charged to disability leave as provided in RCW 41.26.120. FOR MEMBERS OF LEOFF - 2 Each member working standard hours (8 hour shifts)will accrue sick leave in accord ance with the provisions of this section from the date of their hire.Each fire member working the Detroit 56 will accrue 11.0 hours of sick leave per month. Procedures for keeping track of accumulated and used sick leave will be the same as for other city employees. FOR MEMBERS OF LEOFF -1 & 2 All disability leaves will run concurrent with sick leave benefits.And all sick leave benefits will run concurrent with any disability leave.(In the event of sickness or injury requiring prolonged absence,disability leave will be applied for and the sick leave benefits will be included in the time off.) Temporary,seasonal,and retainer employees shall not be entitled to sick leave benefits. When the city is required by state law to continue the salary of an employee because of sickness or disability,the sick leave benefits accumulated hereunder shall run concurrently with the requirements of the state law. Each regular employee,upon first beginning work for the city shall have immediately available for his use,six (6)days sick leave as an "advance"upon sick leave earned in the first six months.If employment is terminated and as a result of such initial advance,the employee has taken sick leave beyond that earned,his terminat ing salary shall be adjusted accordingly. Employees eligible for sick leave with pay shall be granted such leave for the following reasons: A.Personal illness or physical incapacity resulting from causes beyond employee's control. B.Forced quarantine of employee in accordance with community health requirements. Sick leave may be granted by the department director up to and including the second day of consecutive absence.Each application which exceeds two (2)days shall be accompanied by certification of a doctor,if requested by the department director. A report of sick leave used shall be prepared for the City Manager at the end of each month.Any failure to give notice or file a physician's certificate as required herein may be cause for denial of sick leave with pay for the period of absence. When an employee is transferred to another position,any unused sick leave which may have accumulated to his credit shall continue to he available for his use. If the city is required to provide any benefits other than time loss,a proof of submission of medical claim to the insurance carrier and amount paid by insurance company must be supplied to the Finance Department prior to any payment being made by the city. Any rules or regulations established by a Disability Board must be complied with. The effective date of this resolution is February 20,1979.
