RESOLUTION NO.931 A RESOLUTION ACCEPTING THE CONVEYANCE OF REAL ESTATE TO THE CITY OF MOSES LAKE FROM THE BURLINGTON NORTHERN,INC.FOR THE PURPOSE OF MAINTENANCE OF SANITARY FACILITIES AND WATER LINE. WHEREAS,Resolution No.238 provides that all grants of real estate or any interest therein to the City of Moses Lake,shall not be accepted until a resolution of acceptance has been duly passed by the City Council,and WHEREAS,the Burlington Northern,Inc.has presented a Quit Claim Deed conveying property to the City of Moses Lake, NOW,THEREFORE,BE IT RESOLVED that the Quit Claim Deed dated March 27,1979 for the following described property is"hereby accepted by the City of Moses Lake: The GRANTOR,Burlington Northern Inc.,a Delaware corporation,successor in interest to the Northern Pacific Railway Company,for and in consideration of $1.00,receipt of which is hereby acknowledged,and for other valuable consideration, conveys and quitclaims to GRANTEE,the City of Moses Lake,a municipal corporation of the State of Washington,the following described real estate and personal proper ty situated in the COUNTY of GRANT,STATE of WASHINGTON,including any after acquired title: Beginning at a point 40 feet South and 113.24 feet West of the NE corner of Section 19,Township 19 North,Range 29 East.,W.M., and running thence South 28°46,36"West 57 Feet;thence East 79 feet; thence North 50 feet; thence West 52 feet,more or less, to the point of beginning.Containing approximately 0.07 acres. It is the intent herein to convey all that certain parcel of land acquired by Grantor herein by that certain deed dated May 3,1965,from the Utah-Idaho Sugar Company to the Northern Pacific Railway Company as recorded May 17,1965,in Grant County under Auditor's File No.477303. The above site contains both a pumping plant and a portion of a related domestic sanitary sewer facility.This instrument also conveys said pumping plant and related sewer facility. TOGETHER WITH and including all that certain underground domestic sanitary sewer line,including manholes and related facilities,being that same sewer facility installed along Wheeler Road in 1965 by Marchand Construction Company,as designed by Stevens £Thompson,Inc.,for and at the expense of the Northern Pacific Railway Company,and more specifically located as follows: Said domestic sanitary sewer facility lies within and beneath Wheeler Road,meandering within both the North and South halves of said road,from a point beginning 830.00 feet,more or less, East of the Southwest corner of Section 16,Township 19 North, Range 29 East,W.M.;thence extending Westerly along said road to a point which is 870.00 feet,more or less,East of the Southwest corner of Section 13,Township 19 North,Range 28 East,W.M.,all situated in Grant County,Washington.
