RESOLUTION NO,
WHEREAS, the Department of Highways of the State of Washington,
acting as Agents of and for the Bureau of Public Roads of the Department
of Comraerce of the United States of America,is desirous of constructing
a Federal Aid Project No.S 1008 (1)through the City of Moses Lake and
is desirous of routing the traffic on said improvement through said City
of Moses Lake over
Beginning at the intersection of Primary State Highway No,18 and
the Moses Lake Viheeler Road, thence easterly along the Section line
between Sees*I1*and 23 T 19N R28 E.W.M.f to the East corporate limits
of the City of Moses Lake
and crossing other certain intersecting streets and public thoroughfares,
and,
WHEREAS, the Department of Highways of the State of Washington is
desirous of receiving Federal funds for the improvement of said Moses
Lake Wheeler Road, and
WHEREAS, the Bureau of Public Roads of the Department of Commerce
of the United States of America will not participate in the construction
of said Moses Lake Wheeler Road
until and unless the City of Moses Lake will agree to refrain from
permitting encroachments upon the right of way of aaid above-mentioned
streets, and until and unless the City of Moses Lake will agree to
refrain from passing resolutions affecting the free flow of traffic
on said above-mentioned streets or that will give preference1to local
routes which intersect with said streets,other than by the erection
or installation of "slow"and/or "caution"signs or signals,or that
will unreasonably hinder or delay traffic on said above-mentioned streets,
and until and unless the City of Moses Lake will agree,by suitable
resolution,to adopt the grades of the improvement as "the grades of the
city street that is involved,and agree to protect the State of Washing
ton against any and all claims for damages on account of any changes of
grades and the construction of this improvement,and until and unless
the City of Moses Lake will agree to maintain said improvement within
the limits of the City of Moses Lake after the improvement has been
completed|
NOW,THEHEFHE,HE IT RESOLVED by the Mayor and Council of the
City of Moses Lake that for and in consideration of the Department of
Highways of the State of Washington and the Bureau of Public loads of
the Department of Commerce of the United States of America constructing
said Moses Lake Wheeler Road and routing traffic on the same through
the City of Moses Lake over
Beginning at the intersection of Primary State Highway No.18 and
the Moses Lake Wheeler load,thence easterly along the Section Line
between Sees.l*f and 23 T 19N R28 E.W.M.,to the East corporate limits
of the City of Moses,^a^e,,
and crossing other certain,intersecting streets and public thoroughfares,
it hereby agrees with the Department of Highways of the State of Washing
ton ani the Bureaij of Bujjlic Roads of the Department of Commerce of the
United States of America that it will not,in the future,>ermit en
croachments on tljfe right of way of the said above mentioned streets,
nor wilL it pass^any resolutions affecting the free flow of traffic on
said above-mentione%streets or that will give preference to local
routes which intersect with said streets,other than by the erection or
installation of "siowf1 and/or "caution"signs or signals,or that will
slow up, unreasonably hinder,or delay traffic on said above-mentioned
streets,and that it will,by suitable resolution,adopt the grades of
the improvement as the grades of the city street that is involved,and
hereby agrees to protect the State of Washington against any and all
claims for damages on account of changes of grades and the construction
of this improvement,and hereby further agrees to maintain said improve
ment within the limits of the City of Moses Lake after this improvement
has been completed.
