76RESOLUTION N 0.76 WHEREAS,the Department of Highways of the State of Washington,acting as Agents of and for the Bureau of Public Roads of the Department of Commerce of the United States of America,is desirous of constructing a federal Aid ProjectNo. S-1007(2)in Grant Cty through the ,City of Moses Lake and is de sirous of routing the traffic on said improvement through said City of Moses Lake xsr&x known as the Moses Lake-Stratford Road;that the southerly terminus of the Federal Aid Secondary Route No.S-1007 is at its intersect ion with F.A.S.Route No.450,Moses Lake-Ephrata Road,within the corporate limits of the City of Moses Lake-?that as a part of said construction,that portion of said F.A.S.Route Ho.S-1007 will be improved, and crossing other certain intersecting streets and public thoroughfares,and, MERE/IS,the Department of Highways of the State of Washington is de sirous of receiving Federal funds for the improvement of said Moses Lake- S-t-ra +fm-H R^aH,FrA,S.Nn.£-1007 9 and, WHEREAS,the Bureau of Public Roads of the Department of Commerce of the United States of America will not participate in the construction of said Moses Laketr-Stratford Road.F.A.S,.Mo,.S-1007 _,_,—until and unless the City or Moses Lake will agree to refrain from per mitting encroachments upon the right of way of said above mentioned streets,and until and unless the City of Moses Lake , Washington,will agree to re frain from passing ordinances or laws affecting the free flow of traffic on said above mentioned streets,other than by the erection or installation of "slow"and/or "caution"signs or signals and traffic signals regulating the normal flow of traffic in conformity with traffic surveys conducted by the Department of Highways of the State of Washington in conjunction with the Bureau of Public Roads of the Department of Commerce of the United States of America,or that will unreasonably hinder or de lay traffic on said above mentioned streets,and until and unless the City of Mhqpq T.ak-P >Washington,will agree,by suitable ordinance,to adopt the grades of the improvement as the grades of the city streets that are involved and agree to protect the State of Washington against any and all claims for damages on account of any changes of grade and the construction of this improvement without affecting the Federal share payable on account of the project,as provided by the "Federal-Aid Highway Act of l?\\h";and until and unless the City of Moses Lake mwill agree to maintain said improvement within the corporate limits of "bne City °f Moses Lake after the improvement has been completed; NOW,THEREFORE,BE IT RESOLVED by the City Council of the City ofMosesLakethatforandinconsideration of the Department of Highways of the State of Washington and the Bureau of Public Roads of the Department of Commerce of the United States of America constructing said improvement of Mo^pq I ake-Stratford Road,F.A.S.No.S-1007 _,; and routing traffic on the same through the City of Moses Lake <wejrx known as theMoses Lake-Stratford Road;tnat the southerly terminus of Federal Aid Secondary Route No.S-1007 is at its intersection with F.A.S. Route No.450,Moses Lake-Ephrata Road,within the corporate limits of the City of Moses Lake;that as a part of said construction,that portion of said F.A.S.Route No.S-1007 will be improved, and crossing other certain intersecting streets and public thoroughfares,it hereby agrees with the Department of Highways of the State of Washington and the Bureau of Public Roads of the Department of Commerce of the United States of America that it will not,in the future,permit encroachments on the right of way of the said above mentioned streets,nor will it pass any ordinances or laws affecting the free flow of traffic on said above mentioned street other than by the erection or installation of "slow"and/or "caution"signs or signals,and traffic signals regulating the nor mal flow of traffic in conformity with traffic surveys conducted by the Department of Highways of the State of Washington in conjunction with the Bureau of Public Roads of the Department of Commerce of the United States of America,or that will slow up,unreasonably hinder, or delay traffic on said above mentioned streets, and that it will,by suitable ordinance,adopt the grades of the improvement as the grades of the city streets that are involved,and hereby agrees to protect the State of Washington against any and all claims for damages account changes of grades and the construction of this improvement,provided that this agreement shall not af fect the Federal share payable on account of the project as provided by the "Federal- Aid Highway Act of 19liUB,and hereby further agrees to maintain said improvement within the corporate limits of the City ofMoses Lake after this im provement has been completed.
